RD. 24, SOUTH OF MEDINA ROAD, AND WEST OF GARLAND LANE (97144) WHEREAS. Hans Hagen Homes, Inc. has requested final plat approval for Seven Ponds Seventh Addition, a plat of two single family lots on an approximately 1.2 -acre parol on property located east of Co. Rd. 24, south of Medina Road, and west of Garland Lane, WHEREAS, the subject property is legally described as follows: Lots 1 and 2. Block 1, Seven Ponds Seventh Addition. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Hans Hagen Homes, Inc. for a final plat for pro,-" located east of Co. Rd. 24, south of Medina Road, and west of Garland Lane, subiect to the following conditions and findings: 1. A final plat is approved for Seven Ponds Seventh Addit-on in accordance with the application received by the City on September 19, 1997. except as amended by this resoNtion. 2. Access shall be limited to Garland Lane and prohibited from Medina Road and County Road 24. 3. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. • • Resolution 97-664 (97144) Page 2 c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage frcility. d. No building permits shill be issued until the Final Plat is filed and recorded with Hennepin County. e. Submittal of required utility and drainage easement documents as approved by the City Engineer prior to filing the Final Plat. L The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. g. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. h.
