HomeMy WebLinkAboutCity Council Resolution 1997-661• CITY OF PLYMOUTH RESOLUTION 97.661 APPROVING PLANNED UNIT DEVELOPMENT GENERAL PLAN AND FINAL PLAT FOR HOUSING SERVICES FOR PROPERTY LOCATED NORTH OF 45m AVENUE, EAST OF TRENTON CIRCLE, AND WEST OF NATHAN LANE. (97095) WHEREAS, Housing Services has requested approval of a Planned Unit Development General Plan and Final Plat for a 56 -unit apartment building locred on property legally described as Oudot A, Woodlands 2' Addition, Hennepin County; and WHEREAS, the Planning Commission las reviewed said request at a dilly called public Tearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does appruve the request by Housing Services Inc. for Planned Unit Development General Plan and Final Plat, subject to the following conditions: I. Approval of the Planned Unit Development General Plan and Final Plat for the construction of a 56 -unit apartment building, subject to the approval of the Wetland Alteration Permit, according to the plans received by the City on August 8, 1997, except as amended by this resolution. 2. The Planned Unit Development General Plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 3. The following structural setbacks shall apply: a) 170 -foot setback from the west property line b) 280 -foot setback from the north property line c) 170 -foot setback from the east property line d) 25 -foot setback from the south property line. • Resolution 97-661 (97095) Page 2 4. Decks, balconies, and uncovered porches may encroach six (6) feet into the required yard setbacks. 5. Tree and vegetation removal shall be prohibited within 120 feet of the westerly property line, except as shown on the approved grading plan. Removing dead trees, trimming trees to maintain health, and removing trees and branches that create a safety problem may be undertaken with the approval of the City Forester. Natural walkways consisting of wood chips, crushed limestone, or similar material; outdoor furniture such as benches, chairs, swings; and other structures which do not require vegetation removal may, however, be allowed within the 120 -foot wide conservation area, except the westerly 50 feet thereof, subject to the approval of the City Forester. A conservation easement shall be recorded over this area. 6. A deck, for common use by the residents of the building, may be allowed on the northeast side of the building, provided that the deck does not encroach into the wetland buffer. 7. Tire height of the building may not exceed 35 feet. B. Impervious surface coverage shall not exceed fifteen (15) percent of the site. 9. This resolution approves a Fire Code Variance to the requirement for a fire lane within 50 feet of all sides of the senior apartment building, as shown on the plans received by the City on August 8, 1997. 10. Two additional evergreen trees shall be added on the landscaping plan to fill the gap between the two row of evergreens located on the west side of the drive aisle. The applicant shall submit a revised landscaping plan for city review. 11. The proposed lighting as shown on the site plan shall be revised by eliminating the "C" light standards located along the proposed trail. The light standard "B" located at the end of the fire lane shall be changed to a bollard light standard not to exceed 4 feet in height. Light standards "B" shall not exceed 12 feet in height and shall consist of a shoe box fight fixture. Light standards "A" shall not exceed 25 feet in height and shall consist of a shoe box light fixture. Proposed lighting shall not exceed .5 foot candles at the property line. 12. A private sidewalk/trail shall be added along the north side of 45i° street between the entrance to the site and Revere Lone. A revised grading plan and site plan showing the proposed trail shall be submitted prior to issuance of building permits. 13. Wetland buffer monuments shall be located adjacent to all wetlands in accordance with Section 21670.07 of the Plymouth Zoning Ordinance. 0 Resolution 97-661 (97095) Page 3 14. Extraordinary management measures shall be used to control erosion, sedimentation and nutrient loading during and for two years after construction. Buffer strip vegetation performance standards outlined in Section 21670.08 of the City Code shall be provided and maintained. 15. The applicant shall develop a lawn management plan that includes the use of phosphorous free fertilizer to reduce potential negative impacts on the wetlands. 16. The sanitary sewer pipe shall be SDR 26. 17. The domestic water service shall be noted by size and type of material. 18. Note that the watermain will be 7 Va feet deep on the utility plan. A gate valve will be required on the domestic line and provide a gate valve west of the domestic line. 19. Include a detail for the retaining walls. 20. Show location of wetland monuments. 21. Show the emergency ovetfow for the NURP pond on the grading plan. 22. Label the 10:1 bench for all ponds on the grading plan. 23. Show the rock construction entrance to the site. 24. Delete the reference "Following Street Construction" in Note 7 on erosion control. 25. Standard Conditions: A. Compliance with the City Engineer's Memorandum. B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. D. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. F. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. 0. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. • Resolution 97.661 (97095) Page 4 H. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. I. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. J. Compliance with regulations regarding handicapped parking spaces and access.
