RESOLUTION 97 - 659
APPROVING PRELIMINARY PLAT AND SITE PLAN FOR TOWN AND COUNTRY
HOMES, INC. FOR PROPERTY LOCATED IN THE NORTHWEST QUADRANT OF
HIGHWAY 55 AND DUNKIRK LANE (97011)
WHEREAS, Town and Country Homes, Inc. has requested approval of a Preliminary Plat and
Site Plan for property legally described as follows:
That part of the Northeast Quarter of the Southwest Quarter of Section 17, Township
118, Range 22 lying south of a line drawn from a point on the east line thereof distant
659 feet south of the northeast comer thereof to a point on the west line thereof distant
651.7 feet south of the northwest corner thereof.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby dues approve the request by Town
and Country Homes, Inc. for a Preliminary Plat and Site Plan, subject to the following
conditions:
1. Approval of the Preliminary Plat and Site Plan is contingent on the adoption of the associated
Rezoning.
2. A Preliminary Plat and Site Plan is approved for the creation of 108 lots and four oudots, in
accordance with the plat and plans received by the City on September 26, 1997, except as
amended by this resolution.
3. Prior to building permit issuance, the developer shall place a conservation easement on the
wetland on the site in order to enswe that it will not be developed in the fltttue.

4. Revised plans shall be submitted with the Final Plat indicating compliance with the setback
regulations of the City's Wetland Protection Ordinance. This condition requires two roofed
entrance structures to be located outside the buffer setback for the wetland.
5. Uncovered decks may encroach up to six feet into the required wetland setback pursuant to
Section 21670.09 of the Zoning Ordinance.
6. A revised landscape plan shall be submitted with the Final Plat that indicates complies with
the requirement that at least 15 percent of the trees be a long-lived species of 3.5 inches in
diameter.
7. Minimum development standards are as required by the KMF-1 zoning district. No
Variances are granted or implied.
8. Compliance with the Tree Preservation Ordinance.
9. Any signage shall comply with the Sign Ordinance.
10. All existing structures shall be removed from the site prior to filing the Final Plat.
11. The developer must obtain the appropriate permits from the DNR, MPCA, State Health
Department, Bassett Creck Watershed District, City of Plymouth for Wetland Mitigation,
Awry Corps of Engineers, and NPDES prior to issuance of building permits.
12. The Preliminary Plat must be revised to include the name of the Plat.
13. Appropriate legal documents regarding Homeowners Association documents, covenants and
restrictions, as approved by the City Attorney, shall be filed with the Final Plat. Maintenance
of the outlots shall be addressed in the Homeowners Association documents.
14. The developer shall obtain an easement from the landowner to the south for the grading and
landscaping proposed on the lot to the south.
15. Traffic noise from Highway 55 could exceed nois6 standards established by the Minnesota
Pollution Control Agency, the U.S. Department of Housing and Urban Development, and the
U.S. Department of Transportation. Mn/DOT policy regarding development adjacent to
existing highways prohibits the expenditure of highway funds for noise mitigation measures.
The developer shall assess the noise situation and take the action necessary to minimize the
impact of any highway noise.
16. A drainage easement for ponding shall be dedicated on the Final Plat to the elevation of
995.0 for the pond north of 391" Avenue.

M. The Developer shall hold the City and its officers, employees, and agents harmless from
claims made by itself and third pubes for damages sustained or costs incurred resulting
from plat approval and development The Developer shall indemnify the City and its
officers, employers, and agents for all costs, damages or expenses which the City may
pay or incur in consequence of such claims, including attorneys' fees.
