RESOLUTION 97-626
APPROVING LOT CONSOLIDATION FOR PROPERTY LOCATED AT 12001 - 23rd
AVENUE NORTH (97147)
WHEREAS, an application has been filed by Greg Roland which requests approval of a
Lot Consolidation to consolidate two parcels of land located at 12001 - 23rd Avenue
North, as legally described on Attachment One, attached hereto and hereby made a pari
hereof; and
WHEREAS, the proposed lot arrangement for the Lot Consolidation would revise the two
lots, as legally described on Attachment Two, attached hereto and hereby made a part
hereof; and
WHEREAS, the City Council has fully considered the request for the Lot Consolidation.
NOW, THEREFORE, BE IT HEREBY RESOLVED 3Y THE CITY COUNCIL OF
THE CITY OF PLYMOUTH. MINNESOTA, that it should and hereby does approve the
Lot Consolidation for Lots I and 2, Block 2, Penw.;k Addition, subject to the following
conditions:
1. Submittal of separate drainage and utility easement documents executed and in
recordable form prior to issuance of building permits.
2. Prior to ;ssuance of building permits, the applicant must provide the City Attorney
with the Owner's Duplicate Certificate of Title in order that he may file the required
easements referred to above, or the applicant may record the easements and provide
the city with proof of recording.
3. No building permits shall be issued until the Lot Consolidation is filed and recorded
with Hennepin County.

4. Compliance with Policy Resolution 7940 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm waur drainage
Wfity.
S. The Developer shall bold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs hwurrod
resulting from plat approval and development. The Developer shall indemnify the
City and its officers, employee& and agents for all coats. damages or expenses which
the City may pay or incw in consequence of such claims, hicluding attorneys' fees.
