HomeMy WebLinkAboutCity Council Resolution 1997-624• CITY OF PLYMOUTH RESOLUTION 97 - 624 APPROVING SETBACK VARIANCE FOR AN ENTRANCE MONUMENT SIGN FOR THE COURTS AT NANTERRE, LOCATED SOUTH OF SCHMIDT LAKE ROAD AT COMSTOCK LANE (97130) WHEREAS, an application has been filed by Moen Leuer Construction which requests approval of a setback variance to allow construction of an entrance monument sign on property legally derribed as Lot 29, Block 1. The Courts at Nanterre. WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Moen Leuer Construction for a setback variance for an entrance monument sign ten feet from the north lot line and zero feet from the east lot line at The Courts at Nanterre, subject to the following conditions: 1. This setback variance request is hereby approved in accordance with the plans received by the City on Septbember 16, 1997, except as amended by this resolution. 2. This resolution is approved with the finding that the applicable variance standards are met as (ollows: a) the topographic conditions create a hardship; b) the condition relating to the hardship is unique and is not generally applicable to other properties; c) the basis for the request is not based exclusively upon a desire to increase value or income potential; 0 • Resolution 97-624 (97130) Page 2 d) the hardship was not created by the applicant. extreme topographic conditions required for 9 quality Pond; e) the sign would not be detrimental to the public and but rather was crated by the rc bridge approach and water welfare or the neighborhood; f) the sign would not endanger public safety, an the required 30 -foot visibility triangle would be maintained. 3. A sign permit shall be obtained prior to constnu tion of the entrance monument sign. 4. Prior to issuance of the sign permit, the applicant must enter into an encroachment agre=m with the City to encroach :he City easements (e.g., drainage and utility easement,) in the area of the proposed entrance sign monument.
