HomeMy WebLinkAboutCity Council Resolution 1997-617• CITY OF PLYMOUTH RESOLUTION 97 - 617 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR HENRY LAZNIARZ FOR "FERNDALE PLACE" LOCATED AT THE NORTHEAST CORNER OF 127" AVENUE AND FERNDALE ROAD (96038-F) WHEREAS, Henry Lazniarz has requested approval of a Final Plat for Ferndale Place, a plat of four single family lots on a 3.1 -acre parcel located at the northeast corner of 121 Avenue and Ferndale Road, presently known as 1220 Ferndale Road North; and WHEREAS, the City staff has prepared a Development Contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat an: Development Contract Ferndale Place located at the northeast corner of 121 Avenue and Ferndale Road; and, FURTHER, that the Development Contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the Development Contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This Final Plat approval is for Ferndale Place, a plat of four single family lots, in accordance with the plans received by the City on August 1, 1997, except as amended by this resolution. 2. Development standards shall be as specified by the RSF-1 zoning district. • A Lj Resolution 97-617 (96038-F) Page 2 3. Payment of park dedication fees -in -lieu of dedication in accordance with the Dedication Policy in effect at the time of recording the Final Plat. 4. Appropriate legal documents regarding Homeowners Association documents. covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. The documents shall include specific reference to maintenance responsibilities of the shared private drive and the parking restrictions related to the private drive. The documents shall also include disclosure information regarding the future location of the trail to be located along the east side of Ferndale Road. 5. Compliance with the City's Tree Preservation Ordinance. 6. Prior to the issuance of building permits, buffer monuments shall be placed in accordance with Section 21670.07 of the Zoning Ordinance. The monument design shall be approved by the Community Development Department. 7. Subnussion of the required Financial Guarantee and Site Improvement Performance Agreement (SIPA) for completion of site improvements within twelve months of the date of this resolution. The SIPA shall include. but not be limited to, the wetland buffer monuments and signs. B. All homes in this subdivision must front toward the private driveway. 9. The addresses for all homes in this development must be posted at Ferndale Road and on the individual homes. 10. The shared private drive shall be constructed to fire lane standards. I1. SAC and REC charges will be payable at the time building permits are issued. 12. A 20 -foot wide utility and drainage easement is required for the sanitary sewer, watermain, and storm sewer. 13. A drainage easement for ponding to 1026.0 is required. 14. The developer must obtain all necessary permits from the MPCA Sewer, Sate Health Department, and Minnehaha Creek Watershed District. 15. Prior to filing the Final Plat, submittal of a ten -foot wide trail easement along the west border of the site, exclusive of the right-of-way dedication. Notice of such trail easement shall be included in the development/sales documents so that potential buyers will he aware of the future trail for this location. 0 Resolution 97-617 (96038-F) Page 3 16. A sign indicating the future trail location shall be posted in the trail easement prior to selling the lots. 17. Prior to filing the Final Plat, submittal of recorded cross -utility and cross- access easement documents. 18. Site grading and installation of public improvements shall not commence prior to City Council approval of the Final Plat and Development Contract. 19. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. No building permits shall be issued until a contract has been awarded for sewer and water. d. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. e. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. U .Access to the subdivision shall be restricted to the shared private drive and shall be restricted from 121 Avenue and other locations from Ferndale Road. g. Submittal of required utility and drainage easement documents as approved by the Chj Engineer, prior to filing the Final Plat. h. Fire Flow calculations shall be approved by the Fire Division prior to issuance of building permits. L Compliance with all Fire Codes and policies, including those regarding the location of fire hydrants, fire lanes, and fire lane signage. j. Addresses shall comply with the street addressing system, including re- addressing of the existing home. k. No Zoning Ordinance Variances are granted or implied. 1. The shared drive shall be private and shall be maintained by the homeowners association. m. The Developer shall hoAthe City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages, or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees.
