HomeMy WebLinkAboutCity Council Resolution 1997-611• CITY OF PLYMOUTH RESOLUTION 97-611 APPROVING SITE PLAN AMENDMENT Tu � LLOW INSTALLATION OF A 122 - FOOT MONOPOLE TOWER AND EQUIPMENT BUILDING FOR WIRELESS COMMUNICATION SERVICES AT 701 BERKSHIRE LANE (97115) WHEREAS, DCR Planning and Development on behalf of AT&T Wireless Services has requested approval of a Site Plan Amendment for a 122 -foot high monopole tower to be located on the following described property: That part of Lot 1, Block 1, Carlson Center Second Addition, Hennepin County, Minnesota, which lies easterly of the following described line ant its extension: Commencing at the northeast comer of said lot; thence south 89° 34' 25" west, assumed bearing, a distance of 420.51 feet along the northerly line of said lot to the point of beginning of the line to be described; thence south 00 26' 07" east a distance of 546.68 feet to the southeasterly line of said lot and there terminating.. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Meeting and recommends approval. NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DCR Planning and Development on behalf of AT&T VVireless Services for a Site Plan Amendment at 701 Berkshire Lane, subject to the following conditions: 1. This approval is for a Site Plan Amendment for a 122 foot high monopole tower, communication antennas, and a 336 square foot equipment building, pursuant to the application dated July 29, 1997. C7 n Resolution 97115 Page 2 2. A copy of the relevant portions of a signed lease which specifies the shared use of the tower shall be submitted prior to issuance of a building permit. 3. A copy of the relevant portions of a signed lease which requires the applicant to removethe tower and associated facilities when they are abandoned, unused or become hazardous shall be submitted to the City prior to issuance of a building permit. 4. Any additional antennas on the tower shall require Site Plan Review. 5. The project requires applicable building permits prior to construction. 6. The tower shall be painted a non -contrasting color or have a galvanized finish. 7. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. S. The applicant shall demonstrate how the tower will be protected against unauthorized climbing prior to issuance of building permits. 10. Standard Conditions: a Submission of required financial guarantee and Site lunprovement Performance Agreement for completion of this site improvement v.ithin twelve months of the date of this resolution. b. Compliance with the Ordinance regarding the location of fire hydrants and fire lanes, and fire lane signage. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. d. Any subsequent phases ar expansions are subject to required reviews and approvals per Ordinance provisions. e. The Site Plan Amendment approval shall expire in one-year from the date of approval, unless the project is substantially completed or an extension is applied for and granted.
