HomeMy WebLinkAboutCity Council Resolution 1997-584• CITY OF PLYMOUTH RESOLUTION W - SB4 APPROVING ADDITIONAL FINDINGS OF FACT FOR A CONDITIONAL USE PERMIT TO EXTEND OPERATING HOURS AT THE HOLIDAY STATIONSTORE AT THE NORTHWEST CORNER OF HIGHWAY 169 AND BETTY CROCKER DRIVE (97071) WHEREAS, Holiday Stationstores, Inc. has requested a conditional use permit to allow 24-hour operation of a Holiday Stationstore at the northwest comer of Highway 169 and Betty Crocker Drive on property legally described as follows: Lot 1, Block 1, Holidays Betty Crocker Addition, Hennepin County, Minnesota WHEREAS, the City Council has adopted resolutions approving a final plat, site plan and conditional use l..;rmit for the convenience grocery market with motor fuel sales; and WHEREAS, the City Council has adopted a resolution approving a conditional use permit to extend the hours of operation tom 5:00 am. to 11:00 p.m.; and WHEREAS, the, City Council has requested that staff prepare additional findings of fact for the approval of the extended (tours, NOW, TI•IEREFORE, BE 1T HEREBY RESOLVED SY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does support and approve the additional findings t -f fact fora conditionnl u.e permit with extended hours of operation from 5:00 a.m, to 11:00 p.m., based tin the following !hidings: 1. The hours of operation for this ttse are limited to 5:00 a.m, to 11:00 p.m. 2. The presumptive hours of operatim; frr the use specified in the City's zoning ordinance is 6:00 a.m. to 11:00 p.m. .] Resolution 97-584 Page 2 3. The site abuts a residential neighborhood to the south and vwmt property zoned residential to the north. 4. 'There are no existing businesses in the proximity that operate 24 hours per day. S. Twenty -fou; hour operations would disrupt the quietude and comfort of the residents of the existing and planned residential neighborhoods. 6. Twenty-four hour operations would introduce bothersome light, noise, and activity into the residential areas during normal sleeping hours.
