HomeMy WebLinkAboutCity Council Resolution 1997-573• CITY OF PLYMOUTH RESOLUTION 97 - 573 APPROVING PRELIMINARY PLAT AND PUD GENERAL PLAN FOR PIKE LAKE WOODS, INC. FOR PROPERTY LOCATED NORTH OF BASS LAKE ROAD, EAST OF HEMLOCK LANE, WEST OF ZACHARY LANE, AND SOU -M OF EAGLE LAKE REGIONAL PARK (97079) WHEREAS, Pike Lake Woods, Inc. has requested approval of a Preliminary Plat and PUD General Plan for property legally described as follows, Lots 46 to 51 inclusive, Morrison's Lake View Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pike Lake Woods, Inc. for a Preliminary Plat and PUD General Plan, Subject to the following conditions: 1. Approval of the Preliminary Plat and PUD General Plan are subject to the approval of the Land Use Guide Plan Amendment and Rezoning. 2. A Site Plan is approved for seven two -unit townhouse buildings and one three -unit townhouse building, according to the plans received by the City on June 27,1997. 3. A Preliminary Plat is approved for the creation of Lots 1-13, Block 1, and Lots 1-5, Block 2, Pike Lake Woods. 4. Lot 12 and i s, Block 1, and Lot 4 and 5, Block 2 shall be platted as an outiot until a sewer connection is available from cite property to the west. • • 97079pp, Page 2 Res. 97-573 5. The uses allowed in this PUD are any permitted, accessory, conditional or interim uses allowed in the RW -1 (Multiple Family 1) Zoning District; except on Lot 1, Block 2, in the southeast portion of the site, which are any permitted accessory, conditional or interum uses allowed in the C-2 (Neighborhood Commercial) Zoning District. 6. Setback restrictions along the periphery of the residential property are as follows: a. Front yard building setback of 25 feet b. Rear yard building setback of 25 feet 7. Setback restrictions along the periphery of the commercial property are as follows: a. Front yard building setback of 75 feet b. Side yard building setback of 75 feet c. Rear yard building setback of 75 feet 8. All rooftop and ground mounted mechanical equipment shall be designed (including exterior color) and located so to be aesthetically harmonious and compatible with the building. Rooftop equipment over three (3) feet in height shall be screened with durable materials which are aesthetically compatible with the structure. In no case shall wooden fencing be used as a rooftop equipment screen. 9. Th.- slopes on the NURP pond shall not exceed 3:1. 10. Standard Conditions: a Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to. or containing any open storm water drainage facility. c. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. E An 8 1/2 x I1 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect prior to filing Final Plat. h. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. s 11 97079pp,Page 3 Res. 97-573 i. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. j. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. L Submittal of required utility and drainage easements as approved by the City Engineer prior to Sling the Final Plat 1. Compliance with regulations regarding handicapped parking spaces and access. m. 'Ibis approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
