RESOLUTION 97 - 571
APPROVING A CONDITIONAL USE PERMIT AND AN INTERIM USE PERMIT
FOR WALSH CONSTRUCTION COMPANY OF ILLINOIS TO ALLOW
CONSTRUCTION OF A 7 -FOOT HIGH BARB -WIRE FENCE AT PROPERTY
LOCATED AT 13005 STATE HIGHWAY 55 (97101)
WHEREAS, Walsh Construction Company of Illinois has requested a Conditional Use
Permit and an Interim Use Permit to construct a 7 -foot high barb -wire fence on
property legally described as follows:
That put of Lot l lying east of a line described as beginning at a point in the westerly line
thereof a distance of 352.33 feet northerly measuring along said westerly line from the
southwest corer thereof; thence north along a lire perpendicular to the south line of said Lot 1
to its intersection within the north line thereof.
Also that put of the northeast quarter of Section 27 described as beginning at the northeast
corner of Lot t, Block 1 Minneapolis Industrial Park thence northerly along the westerly right-
of-way line of State Highway No. 55 to a point therein distant 111.35 feet north 28 degrees 39
minutes SS seconds west from the south line of north half of the northeast quarter of said
Section 27; thence south 61 degrees 20 minutes 5 seconds west, 150 feet; thence north 28
degrees 39 minutes 5S seconds west, 218.42 feet; thence south 88 degrees 43 minutes, 40
seconds west, 341.76 feet; thence south I degree 16 minutes 20 seconds east, to north line of
said Lot 1, thence easterly along said north litre to beginning, Section 27, Township 118,
Range 22.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Heating and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Walsh Construction Company of Illinois for a Conditional Use Permit
and in Interim Use Permit, subject to the following findings and conditions:

1. The Conditional Use Permit and Interim Use Permit is to construct a Moot high
barb -wire fence at 13005 State Highway SS according to the plans received by the
City on July 1, 1997, except as amended by this resolution.
2. The Conditional Use Permit and Interim Use Permit is to allow a Moot high barb -
wire fence with the fording that all Conditional Use Permit standards would be met.
Specifically:
a. The proposal would comply with the Comprehensive Plan.
b. The proposed fence would promote and enhance the general public welfare and
would not be detrimental to or endanger the public health, safety, morals or
comfort. The Moot high barb -wire fence does not create a safety hazard to,
from or on a public street.
c. The proposed fence would not be injurious to the used enjoyment Y permitted. of of er
property in the immediate vicinity for the purposes

d. The proposed fence would not impede the nornuil and orderly development and
improvement of surrounding property for uses permitted in the 1-2 zoning

g. The proposed fence would comply with the performance standards of the Zoning
Ordinance.
3. This approval shall expire one year after the date of approval, unless the property
owner or applicant has started the project, or unless the landowner or applicant has
received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
