RESOLUTION 97 - 570
APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR HOLIDAY
STATIONSTORES, INC. FOR A CONVENIENCE GROCERY MARKET WITH
MOTOR FUEL SALES LOCATED AT THE NORTHEAST QUADRANT OF
HIGHWAY 169 AND BETTY CROCKER DRIVE (97071)
WHEREAS, Holiday Stationstores, Inc. has requested approval of a Site Plan and
Conditional Use Permit to allow a convenience grocery market with motor fuel sales in
the C4 (Community Commercial) Zoning District on property legally described as
follows:
Lot 1. Block 1, Holidays Betty Crocker Addition, Hennepin County, Minnesota
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval of the Site Plan and the Conditional Use Permit for
Holiday Stationstores, Inc.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY T'dE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Holiday Stationstores, Inc. for a Site Plan and Conditional Use Permit,
subject to the following conditions:
1. The Site Plan allows construction of a 4,232 square foot convenience grocery
market with motor tuel sales, in accordance with the plans received by the City on
July 30, 1997, except as amended by this resolution.
2. The Conditional Use Permit is to allow a convenience grocery market with motor
fuel sales at this location with the finding that all Conditional Use Permit standards
and conditions would be met. Specifically:
a. The proposed use at this location would comply with the Comprehensive Plan;
b. The proposed use would promote the general welfare and would not be
detrimental to, or endanger the public health, safety, morals, or comfort;

C. The proposed use would not be injurious to the surrounding Properties or to
the City as a whole. nor would it substantially diminish property values in the
area;
d. The proposed use would not impede the orderly development of the district;
e. The site plan design would not cause traffic congestion in the public streets;
f. The proposal would meet all the standards for development in the C-4 Zoning
District; and ed in the
g. The Conditional Use Complies with the performance standards standards spec'di
Ordinance.
3. Exterior sales and/or storage of merchandise shall be allowed only upon issuance
of a separate Administrative Permit.
4. The hours of operation for this use will be 5:00 a.m. to 11:00 p.m.
5. The operation shall be responsible for litter control within 300 feet of the premises,
and litter cc ntrol is to occur on a daily basis. Trash receptacles must be provided
on site at convenient locations to facilitate litter control.
6. Prior to issuance of building permits, a revised landscape plan, which complies
with minimum Ordinance standards, shall be submitted for staff review and
approval. The developer shall locate the additional trees in the south/southwest
corner of the property to help screen headlights from the residential property across
the street.
7. Covenants regarding cross access and fire access shall be submitted for staff review
and approval and shall be filed with Hetrnepin County prior to issuance of building
permits.
8. The developer is responsible for a portion of the cost of the intersection
signalization at Betty Crocker Drive and the entrance to this site, as agreed upon in
the development agreement for Willow Grove Office Park V Addition.
9. All signage shall comply with the Sign Ordinance in effect at the time of sign
permit application.
10. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
drainage facility.

c. Submission of the required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of the
date of this Resolution prior to issuance of building permits.
d. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
e. Compliance with the Ordinance regarding the location of fire hydrants, post
indicator valve, fire department connection, fin lanes, and fire lane signage
prior to issuance of building permits.
C An 9 1/2 x 11 inch 'As Built" Fire Protection Plan shall be submitted prior to
the release or reduction of any site improvement bonds per City Policy.
g. Park dedication fees shall be cash fees in lieu of lam dediertion in accordance
with the dedication policy in effect at the time of building permit issuance.
h. Tbe Developer shall hold the City and its officers, employees, and agents
harmless from claims made by itself and third parties for damages sustained or
costs incurred resulting from plat approval and development. The Developer
shall indemnify the City and its officers, employees, and agents for all costs,
damages or expenses which the City may pay or incur in consequence of such
claims, including attorneys' fees.
L No building permits shall be issued until the Final Plat is filed and recorded
with Hennepin County.
j. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
k. Compliance with regulations regarding handicapped parking spaces and
access.
1. This approval shall expire one year after the date of approval, unless the
property owner or applicant has substantially stated construction of the
project, or unless the landowner or applicant has received prior approval from
the City to extend the expiration date for up to one additional year, as
regulated under Section 21045.09 of the Zoning OWinance.
