RESOLUTION 97 - 569
APPROVING FINAL PLAT FOR HOLIDAY STATIONSTORES, INC. FOR HOLIDAYS
BETTY CROCKER ADDITION FOR PROPERTY LOCATED NORTH OF BETTY
CROCKER DRIVE AND WEST OF STATE HIGHWAY 169 (97071)
WHEREAS, Holiday Stationstores, Inc. has requested approval of a Final Plat for 3.0125 acres
located north of Betty Crocker Dive and west of State Highway 169.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat for
Holidays Betty Crocker Addition for property located north of Betty Crocker Drive and west of
State Highway 169, subject to the following conditions:
1. This Final Plat approval is for the creation of one lot in Holidays Betty Crocker Addition, in
accordance with the plans received by the City on July 30, 1997, except as amended by this
resolution.
2. The developer is responsible for a portion of the cost of the intersection signaliration at Betty
Crocker Drive and the shared entrance to this site and Willow Creek Plaza, as agreed upon in
the development agreement for Willow Grove Office Park V Addition.
3. A 30 -foot drainage and uitiliy easement shall be placed over the 84 -inch storm sewer on the
final plat, prior to filing the plat with Hennepin County.
4. A drainage easement for ponding shall be placed over everything below the 889.0 contour,
prior to filing the fund plat with Hennepin County.
5. Covenants regarding shared access with the property to the west shall be submitted for staff
review and shall be filed with Hennepin County prior to issuance of building permits.

6. Standard Conditions:
a. Compliance with the City Engines Memorandum.
b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm water drainage
facility.
c. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of dna date of this Resolution.
d. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator
valve, fire department connection, fire lanes, and fire lane signage.
f. An 8 112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
g. Park dedication fees shall be cash fees in lieu of land dedication in accordance with
the dedication policy in effect at the time of building permit issuance.
h. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the
City and its officers, employees, and agents for all costs, damages or expenses which
the City may pay or incur in consequence of such claims, including attorneys' fees.
i. No building permits shall be issued until the Final Plat is filed and recorded with
Hennepin County.
j. No building permits shall be issued until a contract has been awarded for construction
of municipal sewer and water.
k. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Final Plat.
1. Compliance with regulations regarding handicapped parking spaces and access.
