REQUEST FOR PAYMENT NO.6 AND FINAL

WHEREAS, the City of Plymouth as owner and Kober Excava
have entered into an agreement for 41' Avenue/Hughston Addition n• mp contractor,
Project Yo. 5037, said agreement being dated August 19, 1996; andImprovements, City
WHEREAS, the Engineer has certified his acceptance of the work and his approval of
the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE
CITY COUNCIL OF
THE CITY OF PLYMOUTH, MIIVNESOTA:
1. That the original contract amount was $120,511.49. One change order
was approved in the amount of $7,253.70 and the value of the work to
date is $126,202.42 and is herewith approved. This project underran the
contract amount by $1,562.77, or 1.2%.
2. That the work performed by the contractor for 41' Avenue/Hughston
Addition Improvements and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except
as to the conditions of the performance bond, any and all legal rights of
