HomeMy WebLinkAboutCity Council Resolution 1997-543n CITY OF PLYMOUTH RESOLUTION 97 - 543 APPROVING CONDITIONAL USE PERMIT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF POLARIS LANE NORTH AND 23RD AVENUE NORTH (97 109) WHEREAS, Caliber Development Corporation has requested a Conditional Use Permit to allow up to 85 percent of the total building area for office use when: 50 percent is allowed on property legally described as follows: Outlot B, Pakers Lake Corporate Center, 3'4 Addition and Lot I, Block 1, Parkers Lake Corporate Center 7" Addition, Hennepin Cot nty, Minnesota. WHEREAS, the Planning Conuuission har. reviewed said request at a duly called Public Hearing and recommends approval of office uses not to exceed 85 percent of the total building area. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber Development Corporation for a Conditional Use Permit, subject to the following conditions: I. The Conditional Use Permit is for up to ES percent office use where 50 percent office is allowed by Ordinance. The property is located in the industrial portion of the MPUD for the Parkers Lake Corporate Center PUD and uses must comply with 1-1 (Light Industrial) zoning district uses. 2. Adequate parking is provided for use of the buildings at 85 percent office and 15 percent warehouse. The developer must provide adequate parking for actual uses per the Zoning Ordinance in effect at the time of any changes. 3. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The rermit is subject to all applicable codes, regulations and ordinances, and violation thereof sill be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
