HomeMy WebLinkAboutCity Council Resolution 1997-542ACITY OF PLYMOUTH RESOLUTION 97 - 542A APPROVING PUD GENERAL PLAN AMENDMENT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF POLARIS LANE NORTH AND 2310 AVENUE NORTH (97108) WHEREAS, Caliber Development Corporation has requested approval of a PUD general plan amendment for property legally described as follows; Oudot B, Parkers Lake Corporate Center, 3'd Addition and Lot 1, Block 1, Parkers Lake Corporate Center r Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, NHNNESOTA, that it should and hereby does approve the request by Caliber Development Corporation for a PUD general plan amendment, subject to the following conditions: 1. A site plan is approved for a 51,000 square foot orLce/showroom building, according to the plans received by the City on July 18,1997 and August 22, 1997, except as amended by this resolution. 2. The uses allowed in this PUD would consist of any permitted, accessory, conditional or interim uses allowed in the 1-1 Zoning District. 3. Signage shall be in compliance with the MPUD for Parkers Lake Corporate Center. 4. All waste and waste containers shall be placed within the structure. No outside storage of trash or recycling containers is permitted. 0 Resol-ition 97-542A Page 2 5. All rooftop and ground mounted mechanical equipment shall be designed (including exterior color) and located so to be aesthetically harmonious and compatible with the building. Rooftop equipment over three (3) feet in height shall be screened with durable materials which are aesthetically compRtible with the structure. In no case shall wooden fencing be used as a rooftop equipment screen. 6. The storm sewer must be relocated from the Pintail Villas pond and directed into the wetland mitigation area which outlets to the NURP pond provided for the commerciaUmdustrial area 7. The hours of construction activity shall be limited to 7:00 am. to 5:00 pm. and loading dock operations shall be limited to 7:00 am. to 10:00 P.M. 8. Standard Conditions: L Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. c. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. d. Any subsequent phases or expansions are subject to requited reviews and approvals per Ordinance provisions. e. Compliance with the Ordinance regarding the location of fire hydrants, post indicator valve, fire department connection, fire lanes, and fire lane signage. E An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. g. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. h. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. i. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. j. Compliance with regulations regarding handicapped parking spaces and access. k. This approval shall expire one year after the date of approval. unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance. BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that previous PUD approvals for the plat associated with this development, to be known as Parkers Lake Corporate Center 91° Addition and including Lots 1 and 2 of Block 1, be amended as follows: • • Resolution 95-525, approving an MPUD Preliminary Plan Amendment and Conditional Use Permit, shall no longer apply to Lot 1, Block 1, Parkers Lake Corporate Center 9" Addition. 2. Resolution 95-525 shall continue to apply to Lot 2, Block 1, Parkers Lake Corporate Center 9' Addition. Adopted by the City Council on September 17,1997.
