HomeMy WebLinkAboutCity Council Resolution 1997-542• CITY OF PLYMOUTH RESOLUTION 97 - S42 APPROVING PRELIMINARY PLAT FOR CALIBER DEVELOPMENT CORPORATION FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF POLARIS LANE NORTH AND 231D AVENUE NORTH (97108) WHEREAS, Caliber Development Corporation property legally described as follows; has requested approval of a Preliminary Plat for Outlot B. Parkers Lake Corporate Center, 3'd Addition and Lot 1, Block 1, Parkers Lake Corporate Center 76 Addition, Hennepin County. Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Caliber DeveloMent Corporation for a preliminary Plat, subject to the following conditions: 1. A preliminary plat is approved for the creation of Lots 1 and 2. Block 1, Parkers Lake Corporate Center 9f, Addition, in accordance with the plans received by the City on July 18, 1997. 2. The storm sewer must be relocated from the Pintail Villas pond and directed into the wetland mitigation area which outlets to the NURP pond provided for the commercial/industrial area. 3. Standard Conditions: a Compliance with the City Engineer's Memorandum. b. Compliance with Policy Rcsolution 79.80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. • Resolution 97-342 Page 2 c. Submission of the required Financial Guarantee and Site Performance A mement for completion of site improvements within twelve months of the date of this Resolution. d. Any subsequent phases a expansions are subject to required reviews and approvds per Ordirtama provisions. e. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained of costs incurred resulting from pit approval and development. The Developer shall irdemnW the City and its of icem employees, and agents for all costs, damages or acpeases which the City nay pay or Incur in consequence of such claims, including attowaye fees. E No building permits shall be issued until the Final Plat is filed and recorded with Hennepin Coumy. S. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. h. Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat.
