CITY OF PLYMOUTH
RESOLUTION 97-539
APPROVING FINAL PLAT FOR TOWN AND COUNTRY CATERERS, INC. FOR
PROPERTY LOCATED NORTH OF HARBOR LANE AND EAST OF FERNBROOK
LANE (97096-F)
WHEREAS, Town and Cevntry Caterers, Inc. has requested approval of a Final Plat for the
Plymouth Freeway Center 51 Addition; and
WHEREAS, this 1.92 -acre site is presently legally described as Oudot B. Plymouth Freeway
Center 0 Addition; and
WHEREAS, the Development Review Committee has reviewed said request and recommends
approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE C1.TY COUNCIL OF rHE
CITY OF PLYMOUTH. MINNESOTA, that it should and hereby does approve the request of
Town and Country Caterers. Inc. for a Final Plat for Plymouth Freeway Center 5"' Addition,
subject to the following conditions:
1. The Final Plat shall be in compliance with the plans receive,I by the City on September
8, 1997.
2. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Submittal and approval of fire flow data prior to tiling the Final Plat.
c. Submission of a Site Improvement Performance Agreement prior to issuance of
building permits for the proposed building.
d. Submission of the required park dedication fees prior to Issuance of building permits
for the proposed building.
e. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnity the
City and its officers, employees, and agents for all costs, damages, or expenses
which the City may pay or incur in consequence of such claims, including
attorneys' fees.
