RESOLUTION 97 - SM
APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR TOWN AND
COUNTRY CATERERS, NC. FOR PROPERTY LOCATED NORTH OF HARBOR LANE
AND EAST OF FERNBROOK LANE (970%)
WHEREAS, Town and Country Caterers, Inc. has requested approval of a Site Plan and
Conditional Use Permit for a special event and catering restaurant for property legally described
as Outlot B, Plymouth Freeway Center 0 Addition; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Town
and Country Caterers, Inc., for a Site Plan and Conditional Use Permit for a special event and
catering restaurant, subject to the following conditions:
1. A Site Plan and Conditional Use Permit is approved for a 13,144 square foot special event
and catering restaurant, in accordance with the plans received by the City on July 22, 1997,
except as amended by this resolution.
2. The Conditional Use Permit for the special event and catering restaurant is approved with the
finding that all Conditional Use Permit standards and conditions would be met. Specifically,
1) the proposed usr at this location would comply with the Comprehensive Plan; 2) the
proposed use would promote the general welfare and would not be detrimental to, or
endanger the public health, safety, morals, or comfort; 3) the proposed use would not be
injurious to the surrounding properties or to the City as a whole, nor would it substantially
diminish property values in the area; 4) the proposed use would not impede the orderly
development of the district; 5) the site plan design would not cause tragic congestion in the
public streets; and 6) the proposal would meet all the standards for development in the O -R
Zoning District.

3. No building permits shell be issued until the Fiscal Plat is filed and tecorded with Hennepin
County.
4. Park dedication fes shall be cash fees in lieu of land dedication in accordance with the
dedication policy in effect at the time of building permit issuance.
5. The storage, preparation, and serving of food items are subject to the approval of the Zoning
Administrator who shall provide specific written sanitary requirements based upon applicable
State and County regulations.
6. The dumpster enclosure shall comply with all City ordinances and regulations.
7. Prior to issuance of building permits, the civil and landscape plans shall be revised to indicate
the location of the dumpster enclosure, as indicated on the site plan.
8. The developer must obtain and comply with all necessary permits of Bassett Creek.
9. The Grading, Drainage, and Erosion Control Plan must be revised to indicate the location of
the required crushed rock berm construction entrance, and hay bales around the catch basins.
10. The Utility Plan must be revised to indicate the location of the required post -indicator valve.
11. The Utility Plan must be revised to indicate clean -outs on the internal sanitary sewer system
at a maximum of 100 foot intervals.
12. All water connections shall be via wet tap.
13. The City of Plymouth will televise the sanitary sewer line adjacent to the site to make sure
that no sanitary sewer service is available. If the sanitary sewer connection has to be made in
Fembrook Lane, traffic must be maintained at all times. Adequate signage will be required,
as will flag men to control traffic.
14. The Grading, Drainage, and Erosion Control Plan must be revised to indicate how access will
be provided for maintenance of the NURP pond.
I5. This approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started construction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Section 2 1045.09 of the Zoning Ordinance.

16. Standud Conditions:
A. Compliance with the City Engineers Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
C. Submission of the required Financial Guarantee and Site Performance Agreement for
completion of site improvements within twelve months of the date of this Resolution.
D. Any subsequent phases or expansions arc subject to required reviews and approvals per
Ordinance provisions.
E. Compliance with the Ordinance regarding the location of fire hydrants, post indicator
valves, fin department connections, fire lanes, and fire lane signage.
F. An 81/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement bonds per City Policy.
G. The Developer shall hold the City and its officers, employees, and agents harmless
from claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the City
and its officers, employees, and agents for all costs. damages or expenses which the
City may pay or incur in consequence of such claims, including attorneys' fees.
H. Submittal of required utility and drainage easements as approved by the City Engineer
prior to filing the Final Plat.
1. Compliance with regulations regarding handicapped parking spaces and access.
J. All signage shall comply with the requirements for the O -R district.
