RESOLUTION 97-530
AP:'ROVINO FINAL PLAT/PLAN AND DEVELOPMENT CONTRACT FOR JANCO, INC.
FOR PROPERTY LOCATED NORTH OF THE SOO LINE RAILWAY AND EAST OF
PEONY LANE (96150-F)
WHEREAS, Jamb, Inc. has requested approval of a Final Plat/Plan for Coto Meadows Plat
Two, conuinin roughly 14.08 acres loc&W north of the Soo Line Railway and East of Peony
Lane (directly east of the Conor Meadows plat); and
WHEREAS, this request covers the first phase of Conor Meadows Plat Two, consisting of
nine multi -family lots for 43 townhomes located in the eastern portion of the site; and
WHEREAS, the City staff has prepared a Development Contract covering the improvements
related to said plat.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the Final Plat
and Development Contract for Conor Meadows Plat Two for property located north of the Soo
Line Railway and East of Peony Lane; and,
FURTHER, that the Development Contract for said plat be approved, and that the Mayor and
City Manager be authorized to execute the Development Contract on behalf of the City; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat:
1. This Final Plat approval Is for the creation of nine lots and one outlot in the Concr
Meadows Plat Two Subdivision, in accordance with the plans received by the City on
August 8, 1997, except as amended by this resolution.

2. Prior to filing the Final Plat, payment of park dedication fees -in -lieu of dedication in
accordance with the Dedication 1,they in effect at the time of recording the Final Plat, in
combination with a trail easement along Schmidt Lake Road.
3. Notice of the trail asement along Schmidt We Road shall be itrhtded in the
developm itisales documents so that potential buyers will be aware of the future trail for
this location.
4. The trail to be constructed along Schmidt Lake Road shall not be used far construction
access or storage. Any damage done to the trail, must be repaired by the developer.
s. Appropriate legal documents regarding Homeowners Association documents, covenants
and restrictions, as approved by the City Attorney, shall be filed with the Final Plat.
6. INaintenance of the fence .o be constructed along the sruth boundary of the plat shall be
addressed in the Homeowners Association documents.
7. Prior to issuance of building permits, wetland buffer monuments shall be installed in
amrdance with Section 21670.07 of the Zoning Ordinance. The monument design shall
( be approved by the Community Development Department.
B. Approval of a Wetland Mitigation Plan prior to the issuance of grading permits and filing
of the Final Plat. The Final Plans shall be revised to be consistent with the Mitigation
Plan.
9. Compliance with the Tree Preservation Ordinance.
10. Development Standards shall he as required in the RMF -2 District, except as authorized by
the Variances granted pursuant to Resolution 97-213.
I1. The Final Plat shall not be recorded unfit the City has awarded a contract for construction
of Schmidt Lake Road.
12. No occupancy permits will be issued until Schmidt Lake Road has curb and gutter.
13. No occupancy permits will. be issued for the lots that have driveway access from Jewel
L mel49i° Avenue until the asphalt base has been completed on Schmidt Lake Road.
14. There are no easements to the north for storm drainage, therefore the ponds shall be
constructed for detention to the predevelopment rate and treatment for water quality. The
rate of runoff shall not exceed the one-, five-, ten-, 25- and 100 -year storms.

15. The proposed north -south public street in the plat will initially be named Jewel Lane, until
such time as that street connects to Holly Lane and is re -named 'Holly Lane". The sales
documents for this development must notify home buyers that the street name will be
changed and a new address will be assigned at a foo. re date.
16. Existing Holly Lane shall not he used for contstrucaton access or any access whatsoever to
Conor Meadows Plat Two.
17. All sales literature for properties within Conn; Meadows Plat Two shall disclose
information relating to the presence of the existnnr nearby gun club. inctisling location aryl
hours of operation.
18. Fencing shall be continued eastward along the southern border of the plat. south of the
could -family area.
19. Prior to filing the final plat, the plat shall be revised to indicate the corrected applicant
20. Standard Conditions:
a. Compliance with the City Engineer's Memor. !alum.
b. Removal of all hazardous trees from the pro, erty at the owner's expense.
c. No buildhig permit shall be issued until a contract has been awarded for sewer and water.
d. Street names shall comply with the City Street Naming System.
e Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
C No building permits shall be issued until the Final Plat is filed and recorded with Hennepin
County.
g. Private driveway access shall be limited to internal public roads and restricted from
Schmidt Lake Road. There shall be no driveway access to existing Holly Lane.
b. Location and number of fire hydrants shall be approved by the Fire Division.
I. Submittal of fire flow data with the Final Plan/Plat.
j. Approved fire department turnarounds will be required for the private drives and a
temporary cul-de-sac is required at the south end of Jewel Lane.
k. All lots abutting ponds shall have basement elevations at least two feet above the 100 year
high water elevation.
1. A maintenance agreement is required between the Developer and the City for the water
quality ponds.
m. Submission of a Site Improvement Performance Agreement prior to issuance of building
permits. The agreement shall include, but not be limited to, installation of the required
fence.

n. The Developer shall hold the City and its officers, enemyees, and agents humlcu from
Claims made by itself and third parties for damages stztained or costs incurred resulting
from plat approval and development. The Developer shall indemnify the City and its
officers. employees, and agents for all costs, damages, or expenses which the City may pay
or incur in conugttenm of such c!aims, including attorneys' fees.
o. Subsequent phases shall be subject to ordinance provision for plan and plat applications
for the review and approval.
