FOR PROPERTY LOCATED NORTH OF ROCKFORD ROAD BETWEEN 1494 AND PIMMHIRE LANE (97070) WHEREAS. Baber Partners. Inc. has requested approval of a Preliminary Phu and PUD General Plan for property legally described as follows: Lot 2, Block 1, Plymouth Business Center a Addition, except that pan lying easterly and northerly of the following desmfbed line: Beginning at the most northerly corner of said Lot 2. thence southeasters; along the northeasterly line of said Lot 2 and its southeasterly extension to the south line of the north five feet of said Lot 2; thence easterly along said south line to the east fine of said Lot 2 and there said line terminates. M1 Lot 8, Block 2, Plymouth Office Commercial Park, and the vacated Annapolis Circle as dedicated and delineated on the tec^:a^a plat of Plymouth Office Commercial Park, lying west and south of the following described line: Beginning at the northwest corner of Lot 7, Block 2, Plymouth Office Commercial Park; thence northeasterly along a line radial to the centerline of said Annapolis Circle to said centerline; thence westerly along said centerline to the easterly right-of--wky of Berkshire Lane and there said terminates. WHEREAS, the Planning Commission has -reviewed said request at a duly called Public Hearing and recommends approval. st Resolution 97-528 (97070) Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA. that it should and hereby does approve the request by Bober Partners, Inc. for a Preliminary PW and PUD General Plan, subject to the following conditions: 1. Approval of the Preliminary Plat and PUD General Plan le oft on the adoption of the associated Lud Use Ouide Plan Amendment and Rezoning. 2. A Preliminary Plat is approved for the creation of Lots 1 through S. Black 1. The Plymouth Collection. in accordance with the plat and plata received by the City an August Be 1997, except as amended by this resohttion. 3. A PUD General Plan is approved for 1) a 9.800 square foot expansion to due exisft oAice building on Lot 1; 2) a new 39,400 -square foot (plus 14,300 square fat of basement storage space) retail anter on Lots 2-4 containing a 4.000 square foot convenience grocery market with motor lite! sales and a 2.100 square foot car wash, retail spaces tooling 29,600 a*= feu. and a 3.700 square foot attaeled restaurant with drive4hrough window. and 3) a 6,000 square foot free-sunding, sit-down restaurant with llqua service, also on Lot S. in accordance with the plans received by the City on July 14, 1997, except as amended by this resotution. 4. The permitted uses in the PUD shall include any permitted. accessory, conditional or interim uses allowed in the C-1 and C-2 districts. In addition, the following uses shall be permitted in the PUD provided they do not exceed 20.000 square feet in building area on an individual basis: 1) appliance and electronic: stores; 2) book. office supply, and stationary stores; 3) car wash accessory to a convenience grocery market with motor Nei sales; 4) convenience restaurant with drive-through service; :i) dry cleaning including plant and accessory pressing and repair; 6) fabric/notions stores; 7) free-standing restaurant with liquor service; 8) furniture stores; 9) jewelry stores: 10) music stores; 11) sewing machine sales and service; and 12) toy stores. All the stated uses listed in Condition 4 above shall be considered "permitted" uses in the PUD, provided they comply with all development standards and conditions for such uses under the most restrictive corresponding conventional zoning district. 6. Minimum development standards are as indicated on the PUD General Plan. 7. Three free-standing signs are approved for the development, one for Lot 1, one for Lot 2 and one for Lot 5 as indicated on the Site Plan received by the City on July 14, 1997. Any signage shall comply with the sign regulatioas for the C-2 district. 8. The drive aisle setback along the north lot line is modified to five feet. Resolution 97-528 (9=) Page 3 9. The applicant shall obtain and provide recorded evidence of an easement or other approved imatrumett to permit the imalht M of Wndaaping along the mouth portion of the iadnmial Property to the north, prior to issuance of any building permits on Lots 24. 12. Compliance with the Tree Preservation Ordinance. 13. landscaping shall be in compliance with the Landscape Plan t+ Wved by City on August l 1. 1997. 14. The developer shall install a sail kditg kom the Rockford Road trail into the site. as approved by staff. 13. The internal walkways shall be constructed of patterned concrete, asphalt. or other material as approved by the City. and shall be visibly different in color and texture than the parking lot surface. 16. Cross easements for access. driveways. parking, utilities. and fire access between Lots 1 through S shall be submitted for staff review and shall be filed with Hennepin County prior to issuance of building permits. A drainage and utility easement for the relocated sanitary sewer shall be shown on the Final Plat. 19. A portion of the existing sanitary sewer easement lying troth of manhole 2 may be vacated at the request of the developer. 20. The developer must obtain and comply with all necessary permits of Hennepin County, Bassett Creek. and NPDES. 21. The location of the crushed rock berm at the construction entrance must be noted on the plans. a Resolution 97-528 (97070) Page 4 22. Additional sanitary sewer clean -outs must be provided, as approved by staff. 23. Prior to building permit issuance, the County must have agreed to the necesM changes to the Berkshire Lane southbound approach to the intersection, as identified in the March 18, 1997 traffit: study. #.ny costs related to the improvement to the Berkshire Lane southbound approach to the intersection shall be the responsibility of the developer. 24. All plan sheets shall be revised to clearly indicate the new drive and parldcg configuration proposed on the existing real estate office building site. The ph= shall also indicate the concrete curb and gutter with double-line symbol and aaall note the existing concrete curb and gutter .o be removed. 25. The abandoned sanitary sewer shall either be removed or the pipe filled with sand. All manholes shall be removed. This shall be noted on the Utility Plan. 26. Plan and profile sheets for the sanitary sewer shall be submitted for review and approvpil. A financial guarantee for the sewer shall be included in the Site Improvement Performance Agreement. A two year maintenance bored will be required for the sanitary sewer relocation. 27. The required Stormwater Treatment ORW) Pond has not been provided except fir the southeast portion of the site. Treatment shall be provided for all now hared surface areas. Prior to building permit issuance, the plau for treatment shall be submitted and approved. 28. This resolution approves a Fire Code Variance to the requirement for a fire lane within 50 feet of all sides of the office building for Lot 1 and for the free-standing restaurant building for Lot 5. as shown on the plans received by the City on July 14, 1997. 29, Standard Conditions: A. Compliance with the City Engineer's Memorandums. B. Complian::c with Policy Resolution 7Q-80 regarding minimum floor elevations for new structures vri sites adjacent to, or cotuaining any open storm water drainage facility. C. Submission of the required Financial Guarantee and Site Perfs rmance Agreement for completion of site improvements within twelve months of the date of thi. Resolution. D Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. E. Compli ince with the Ordinance iegardinq the location of fire hydrants, post indicator valves. fire department connections, fire lanes, and tine -ane signage. F. An 8 1/2 x 11 inch "AS Built" Fire Protection Plan sl ill be submitted prior to the release or reduction of any site improventi-tit bonds per City Policy. • Resolution 97-528 (97070) Page 5 G. Park dedication fees shall be cash fees in lieu of tarn I dedication in accordance with the dedication policy in effect at the time of building permit issuance. H. Access shall be restricted from I-494 and Rockford Road. 1. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may Pay or incur in consequence of such claims, including attorneys' fees. I. No building permits shall be issued until the Final Plat is filed and recorded with Hennepin County. IL Submittal of required utility and drainage easements as approved by the City Engineer prior to filing the Final Plat. L.
