CITY OF PLYMOUTH
RESOLUTION NO. 97-511
APPROVING WETLAND MITIGATION AND REPLACEMENT PLAN
THE VILLAGE AT BASSETT CUEK (97080)

WHEREAS, the developer(s) of The Village At Bassett Creek, proposes to fill wetlands for
the construction of residential homes; mW
WHEREAS, these are no reasonable alternatives for the lac ation of the project; and
WHEREAS, a Mitigation Plan was prepared replacing the wetlands in kind at a 2 to 1 ratio
which is required by the Wetland Conservation Act of 195+1; and
WHEREAS, the Replacement Plan meets the requiremei, s of the Weiland Act.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the Mayor is authorized to execute the LOU'S Findings
of Facts, approving the filling of wetlands and the le,ilacement Plan The Village At Bassett
Creek, subject to the following conditions:
1. The replacement wetland must be monitored fur a five (5) year period from the date of
completion.
2. Thc developer's wetland consultant shall subn - an annual mocitoring report to the city of
Plymouth on the anniversary date of the comp►etion of the replacement wetland for a period
of five (5) years containing information required in WCA rule 8420.0620.
3. The replacement wetland must be constructed concurrently with site grading.
4. The developer shall submit a letter of credit in the amount of the cost of the Replacement
Plan. The letter of credit shall be for a period of five (5) years. If during the fiscal year
period the replacement wetland does not perform as proposed in the plan, work as necessary
shall be undertaken by the developer to bring it into conformance.
5. A deed creating a restrictive covenant running with the land for the replacement area must be
recorded. The deed shall be submitted to the City for approval before recording.
6. The developer shall comply with the City of Plymouth Ordinance 93.2 (Wetland Buffer
Standards)
7. Prior to grading, the applicant will provide to the city a construction sequencing plan to
include the details for the reconstruction of all temporary impacted and mitigated wetland
basins and mitigated buffers. A scale cross section will be also provided for all mitigated
wetlands and buffers.

8. The applicant will continue monitoring the five installed shallow ground water wells and will
provide a report prior to any site activity, a monthly report during the site grading, and an
anmW report during the monitoring of the replacement wetlands.
