RESOLUTION NO. 97-505
REQUEST FOR PAYMENT NO.6 AND FINAL
WES713RANCH 3m ADDITION - PHASE I
UTILITY AND STREET IMPROVEMENTS
CITY PROJECT NO. 4015
WHEREAS, the City of Plymouth as owner and Nodland Construction Co. as contractor,
have entmd into an agreement for Westbrancb 3" Addition . Phase 1. Utility and Street
Improvements, City Project No. 4015, said agreement being dated August 14, 1995; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $359,041.70. Two change orders
were approved in the amount of $5.927.50 and the value of the work to
date is 5344.797.00 and is herewith approved. This project underran the
revised contract amount by $20,172.20 or 5.6%.
2. That the work performed by the contractor for Westbtanch Sed Addition -
Phase 1. Utility and Street Improvements and certified to the Council by
the engineer as acceptable, being the same, is hereby released from the
engineer as acceptable from the contract except as to the conditions of the
performance bond. any and all legal rights of the owner. required
guarantees and correction of faulty work after final payment.
3. Request for Payment No. 6 and Final in the amount of $17.239.85 to
Nodland Construction Co. for Westbranch Yd Addition - Phase 1, Utility
and Street Improvements is hereby approved and the City Finance Director
is hereby authorized and directed to pay the same forthwith.
