RESOLUTION 97493
APPROVING PLAN1410 UNIT DEVELOPMENT GENERAL PLAN AMENDMENT FOR
THE DAMONE GROUP FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER
OF VICKSBURG LANE AND 22ND AVENUE (97094)
WHEREAS, The Damone Group bas requested approval of a Planned Unit Development
General Plan Amendment for a S2 -resident senior assisted living residence fur Alternative
Living Services for property located at the southeast corner of Vicksburg Lena and 22a°
Avenue; and
WHEREAS, the Planning Commission bas reviewed :.aid request at a duly called public
hearing and recommends approval.
NOW. THEREFORE. BE IT HERBY RESOLVED BY THE CITY COUNCIL OF
CITY OF'PLYMOUTH, MINNESOTA, that it should and hereby does approve

The Damone Group for a Planned Unit Development General Plan Amendment, subject to the
following conditions.
1. The Planned Unit Development General Plan Amendment allows rr%Mtruction of a 52 -
resident senior assisted living residence, In accordance with the plans received by the
City on Jane 27, 1997 and July 23, 1997 and August 6, 1997, except as amended by
this resolution.
2. The Planned Unit Development General Plan Amendment is approved based on the
finding that the proposed projec. is consistent with the City's Comprehensive Plan, the
intent of the Parkers Lake PUD and the architectural style of the surrounding area.
3. The approved colors for the project are cream -colored for the vinyl siding, white for
the trim, white -washed for the fence, blended cream/tan for the brick on the building
and the fence posts and weathe►ed wood for the asphalt/fiberglass shingles.

4. Prior to issuance of building permits, the applicant shall revise the Site Plan and
elevations to show either interior storage of trash or a storage area integrated with the
rear service area of the building.
S. Prior to issuance of building permits, the applicant shall revise the Site Plan to show the
generator and transformer on the south side of the proposed building.
6. Prior to issuance of building permits, the applicant shall revise the Ligbdng Plan to
show the standard NSP residential lantern style lighting at a height consistent with the
rest of the PUD.
7. Prior to the issuance of building permits, the applicant shall revise the grading plan to
show a three to four foot berm along Vicksburg Lane according to the draft plan
received by the City on August 19. 1997.
B. Prior to issuance of building peranits, the applicant shall revise the plans to indicate the
allowable area calculations for staff review and approval.
9. Prior to issuance of building permits, the applicant shall revise the plans to comply with
the Fire Division requirements relating to spacing of fire hydrants and submittal of fire
flow calculations.
10. Variances from the Fire Code are granted for the elimination of fire lanes on the north
and west sides of the building, subject to the building being protected by automatic fire
alarm and sprinkler systems and fire standpipes located at approved interior locations.
11. Prior to the issuance of a certificate of occupancy, wetland buffer monuments shall be
installed in accordance with Section 21670.07 of the Zoning Ordinance and buffer strip
vegetation planted in accordance with the standards in Section 21670.08, Subdivision 3.
The monument design shall be approved by the Community Development Department.
12. The existing trail along 22e0 Avenue is not to be used for access or construction storage.
The developer will be responsible for repairing any damage done to the trail during
construction.
13. The developer shall be responsible for a proportionate share of the on-going
maintenance of common areas covered by the Master Homeowners Association.
14. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.

C. Submission of the required Financial Guarantee and Site Performance Agreement
for completion of site improvements within twelve months of the date of this
Resolution.
D. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.
E. Compliance with the Ordinance regarding the location of fire hydrants and fire lane
signage.
F. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
