RESOLUTION 97 - 482
FIRST AMENDMENT TO AGREEMENT FOR
OPERATION AND MANAGEMENT OF THE
PLYMOUTH METROLINK SYSTEM
WHEREAS, The City of Plymouth under the Minnesota Transit Demonstration Project
commonly known as "Opt -Out," has initiated the Plymouth Metrolink and Plymouth Dial -A -
Ride Transit Programs; and
WHEREAS, The City annually submits an application to the Metropolitan Council for the
funding required for the provision of such programs; and
WHEREAS, the City Council has been apprised of the proposed program for the calendar year
1997, including its funding implications; and
WHEREAS; the stuff is currently preparing the required application to the Metropolitan Council
for the funding required for the provision of such programs for calendar year 1998; and
WHEREAS, pursuant to Resolution No. 95-192 approved by the Plymouth City Council on
March 21,19950 the City of Plymouth and MCTO agreed to an extension of existing contract 93-
000-071 from the expiration date of March 26, 1995 through July 31, 1997 with two rate
changes; and
WHEREAS; this revised contract provides for a total opemdq rate per revenue hour for large
buses provided by MCTO of $103 per hour initially to $106.50 in the final year, and
WHEREAS; during the lifetime of this revised contract new and/or newer vehicles may be
provided on an agreed upon schedule.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That it should and hereby does authorize the Mayor and the
City Manager to enter into the First Amendment to Agreement for Operation and Management of
the Plymouth Metrolink System with the Metropolitan Council for the provision of large buses
for transit services for the period from August 1, 1997 based on the contract price of $110.31 per
revenue hour detailed in the amendment to the agreement identified as Contract No. 95-000-026.
FURTHER BE IT RESOLVED THAT, the parties agree that the Metropolitan Council shall
continue the service as provided in the agreement until a new agreement for providing Plymouth
Metrolink service is negotiated and approved by the parties or until December 31, 1997,
whichever is earlier.
