HomeMy WebLinkAboutCity Council Resolution 1997-46911 CITY OF PLYMOUTH RESOLUTION 97-469 APPROVING A VARIANCE FOR A SIDE YARC SETBACK AND A VARIANCE FOR A FRONT YARD SETBACK FOR DAVID AND CINDY BEARMAN FOR AN ADDITION TO THE HOUSE AND GARAGE AT 3725 WELLING FON LANE NORTH (97088) WHCREAS, David and Cindy Bearman have requested approval of two Variances for property legally described as follows: Lot 8, Block 4, Wellington Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by David and Cindy Bearman for a Variance for a 10 -foot side yard setback where 15 feet is the requirement, and a Variance for a 22.75 -foot front yard setback where 25 feet is the requirement, based on the following findings: 1. The hardship is caused by the pie -shaped lot which narrows toward the rear property line. 2. The Variances are required due to the angle of the side lot line on this pie -shaped lot and are not applicable to other property in this zoning district. 3. The Variances are not based exclusively upon a desire to increase the value of the property. 4. The hardship is caused by the Zoning Ordinance change from a 10 -foot side yard setback requirement of the Subdivision Unit Project to a 15 -foot side yard setback required by the 1996 Zoning Ordinance. 5. Granting the Variance will not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood because many homes in the neighborhood are built at the 10 -foot setback. • • I Resolution 97.469 Page 2 6. The Variances will not substantially increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neigbbodxxg . 7. The Variances are the minimum necessary in order to conduct a small addition to the garage. An undue hardship would be caused if the applicant is not allowed to expand their home.
