HomeMy WebLinkAboutCity Council Resolution 1997-450• CITY OF PLYMOUTH RESOLUTION 97 - 450 APPROVING AN INTERIM USE PERMIT FOR JOHN AND KAREN GRAY FOR DEPOSIT OF 600 CUBIC YARDS OF FILL AT PROPERTY LOCATED EAST OF 4460 COMSTOCK LANE NORTH (97087) WHEREAS, John and Karen Gray have requested an Interim Use Permit to allow deposit of fill on property legally described as follows: Lot 6, Block 3, GoINiew Estates and Lot 2, Block 1, GolMew Woods. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Acaring and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by John and Karen Gray for an Interim Use Permit, subject to the following conditions: 1. The Interim Use Permit is to allow deposit of 600 cubic yards of fill according to the plans received by the City on June 20,1997, except as amended by this resolution. 2. A grading permit 1}om the building department is required prior to deposit of fill on this site. All work shall comply with the conditions of the grading permit. 3. Prior to issuance of a grading permit, written right -of -entry must be provided to the Zoning Administrator to enter the land for the purpose of determining compliance with all applicable conditions imposed on the operation. 4. A Financial Guarantee is required as part of the building permit application. S. Silt fence must be installed along the berm adjacent to Old Rockford Road and maintained until vegetation is established. • 9 Resolution 97450 (97087) Page 2 of 3 6. The proposed berm must not extend any farther easterly as shown on the plan. This would block the required drainage from this property to the drainage ditch along County Road 9. 7. No drainage shall be diverted onto Lot 3, Golfiriew, Est-mtes. The plan shall be revised to show a drainage swale to County Road 9 ditch. B. A note shall be placed on the grading plan that the beim will have pamamt vegetation established complying with Ordinance No. 95-18, erosion control. 9. At the completion of the grading operation, the premises shall be seeded or sodded with grass. 10. All grading operations shall be completed within 180 days of issuance of the grading permit.
