RESOLUTION 97449
APPROVING SIDE YARD SETBACK VARIANCES FOR GERALD HARTY FOR
PROPERTY LOCATED AT 2530 WEST MEDICINE LAKE DRIVE (97081).
WHEREAS, Gerald Harty has requested approval of side yard setback Variances to allow
a 4.9 -foot side yard setback from the north property line and a 10.4 -foot side yard setback
from the south property line where 15 feet is required, in order to construct an attached
garage on their property at 2530 West Medicine Lake Drive, and:
WHEREAS, the Q--Sject property is legally described as:
Lot 1, Block 8, Elmhurst, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
meeting and recommends approval;
NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request of Gerald Harty for side yard setback Variances based on the following findings
and conditions:
1. This Variance allows construction of a360 square foot (15 x 24) attached garage with
a 4.9 -foot side yard setback from the north property line and a 10.4 -foot side yard
setback firom the south property line where 15 feet is required, in accordance with the
application and survey received by the City on June 11, 1997.
2. The height of garage shall not exceed the height of the existing home.

3. The size and shape of this lot and the location of the existing home creates a hardship
in locating a garage on the property.

4. The hardships identified by the applicant are unique to this parcel because the
property currently does not have a garage. All other properties within the surrounding
area have at least a one -car garage.
5. The Variance request is not based exclusively upon a desire to increase the value of
the property; but rather. to enjoy a reasonable use of the property. A single-family lot
without a garage is generally considered a hardship in the State of Minnesota because
of the cold winters. Further, storage space outside of the home is required for lawn
maintenance and snow removal equipment.
6. The hardships are not self-created. The size of the lot and location of the existing
home makes it impossible to construct a reasonable size garage without setback
variances.
7. Granting the Variances will not be detrimental to the public welfare or injurious to
other land in the neighborhood because the garage would be located approximately 14
feet from the home to the south and approximately 21 feet to the home to the north.
B. The granting of the requested variances will not impair an adequate supply of light
and air to adjacent property because the garage addition will be at least 14 feet from
the nearest structure. In addition, the garage will be farther liom adjacent structures
than is the existing home.
9. A one -car garage is a reasonable size garage for a parcel of this size. it is not possible
to significatirtly reduce the size of the proposed garage and still have a useable garage.
