HomeMy WebLinkAboutCity Council Resolution 1997-4430 CITY OF PLYMOUTH RESOLUTION 97-443 APPROVING PRELIMINARY PLAT FOR CHARIS HOMES FOR PROPERTY LOCATED AT 4265 FERNBROOK LANE NORTH (%186) WHEREAS, Charis Homes has requested a Preliminary Plat for Vingsview Heights Fourth Addition, a plat of two single family lots on a 1.0 -acre parcel located at 4265 Fernbrook Leve North. WHEREAS, the subject property is legally described as follows: The south 165.00 fat of the east 264.00 fat of the northeast quarter of the northeast quarter of Section 16, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Charis domes for a Preliminary Plat for property located at 4265 Fernbrook Lane North, subject to the following conditions and findings: 1. Preliminary Plat approval is hereby granted for Kingsview Heights Fourth Addition in accordance with the plans received by the City on June 18, 1997, except as amended by this resolution. 2. Development of the subdivision shall comply with the City's Tree Preservation Ordinance. 3. There shall be only one driveway access to Fernbrook Lane for both lots. The necessary cross access easements shall be filed with the Final Plat. u 0 4. Structures or decks are prohibited in the drainage and utility easements. S. Standard Conditions: L Compliance with the City Engineees Memorandum. b. Removal of all harardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 7940 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. d. No building permits sball be issued until the Final Plat is filed and recorded with Hennepin County. e. Submittal of required utility and drainage easement documents as altprovml by the City Eogrtteer prior to filing the Final Plat. L The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting from plat approval and development.
