HomeMy WebLinkAboutCity Council Resolution 1997-424CITY OF PLYMOUTH RESOLUTION 97.424 APPROVINO A CONDITIONAL USE PERMIT AND FOUR VARIANCES FOR MOUNT OLIVET LUTHERAN CHURCH FOR PROPERTY LOCATED NORTH OF OLD ROCKFORD ROAD. WEST OF LARCH LANE AND EAST OF SUBURBAN HENNEPIN REGIONAL PARK (97052) WHEREAS, Mount Olivet Lutheran Church has requested approval of a Conditional Use Permit and four Variances for property legally described as follows: That pari of Section 14, Township 118, Range 22, described as follows: Commencing at a point 2 rods east of the Southwest comer of the Southeast 1/6 of the Northwest'/. of said Section 14; thence North IS rods; thence East 10 rods; thence Southerly 16 rods to a point 12 rods East of the point of beginning; thence West to point of beginning; all according to the Government survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mount Olivet Lutheran Church for a Conditional Use Permit for off-site parking and for Variances, subject to the following conditions: t. This Conditional Use Permit is to allow a parking lot as a principal use in the P -I (Public/Institutional) Zoning District as shown on plans received on May 6,1997, and revisions received May 30,1997, except as amended by this resolution. 2. The church is responsible for installation and maintenance of the cross walk and proper cross walk signage on Old Rockford Road. 3. Prior to issuance of building permits, the landscaping plan shall be revised to provide a green belt planting strip or a fence on the north property line to screen the parking lot from adjacent residential properties. 4. A Variance to allow off-site parking more than 300 feet from the main entrance is approved based on the finding that the need for the Variance is based on the location of the church and Old Rockford Road which prohibit use of this site for off-site parking that meets the required maximum distance and the request mets the seven Variance standards in the Zoning Ordinance. A Variance is approved for a 10 -foot front yard setback where 30 feet is requir4 based on the finding the request meets the seven Variance standards in the Zoning Ordinance. Old Rockford Road is a dead end road west of the church. Only four homes are located west of the church and; therefore, the decreased setback will not adversely affect traffic an Old Rockford Road 7. A Variance is approved for a 28 -foot rear yard setback where 30 -feet is required, based on the finding that additional screening will be provided on the north lot line to screen the parking lot from the adjacent residential properties. The additional screening will reduce the potential glare of headlights onto the northern residential properties and; therefore, the decreased setback will not adversely affect adjacent property owners. The request meets the seven Variance standards in the Zoning Ordinance. 8. Standard Conditions: A. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility B. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. C. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. D. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. E. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on July 16,1997. •
