HomeMy WebLinkAboutCity Council Resolution 1997-423• CITY OF PLYMOUTH RESOLUTION 97423 APPROVING A SITE PLAN AMENDMENT AND VARIANCE FOR MOUNT OLIVET LUTHERAN CHURCH FOR PROPERTY LOCATED AT 12235 OLD ROCKFORD ROAD (97052) WHEREAS, Mount Olivet Lutheran Church has requested approval of a Site Plan Amendment and Variance for parking setback for property legally described as follows: That part of the East half of the Southwest one-quarter of Section 14, Township 118, Range 22 described as follows: Beginning at the Northwest corner of said tout; thence running East along the North line of said tract 300 feet; thence running South parallel to the West line of said taut 500 feet; thence West parallel to the North line of said tract 300 feet to the West line of said tract; thence North along the West line of said tract 500 feet to the point of beginning. ALSO all that part of the East 'A of the Southwest '/. of said Section 14, Township 118, Range 22 described as follows: Commencing at a point on the North line of said East Ya of the Southwest %. distant 300 feet East of the Northwest comer thereof; thence South parallel with the West line of said East % of the Southwest Ve a distance of 24.18 feet, more or less, to the centerline of County Road 9 now laid out and traveled; thence continuing South along the last described course a distance of 250 feet to the actual point of beginning of the tract of land to be described, said point of beginning being the Southwest comer of that tract of land described in Book 2132 of Deeds, Page 533; thence East at right angles a distance of 180 feet; thence South parallel with the West line of slid East Ya of the Southwest'/. a distance of 327.39 feet, more or less, to the intersection with a line drawn parallel with and 600 feet South of the North line of said East 'A of the Southwest''/.; thence West along the last described parallel line a distance of 480 feet to the West line of said East '% of the Southwest %; thence North along said West line a distance of 100 feet; thence East parallel with said North line of the East 'A of the Southwest''/. a distance of 300 feet to the intersection with a line drawn South from the actual point of beginning parallel with the West line of said East'A of the Southwest 1/4 of Section 14; thence North along the last described parallel line to the actual point of beginning. Subject to the right of way of County Road 9, as the some appears from the abstract of title submitted to us containing 29 entries and last certified by the North Star Abstract fit Title Guaranty, Inc. under the date of December 4, 1967, at 7 am., and from the examination of the records at the office of the Register of Deeds in and for Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. • Resolution 97473 Page 2 NOw, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mount Olivet Lutheran Church for a Site Plan Amendment and Variance for parking expansion at 12235 Old Rockford Road, subject to the following conditions: 1. This Site Plan Amendment is for a pulsing lot expansion and revision on the existing puking lot at 12235 Old Rockford Road, as shown on plans received on May 6,1997 and revisions received May 30, 1997, except as amended by this resolution. 2. The retaining wall design shall be submitted for review and approval by the Engineering Division prior to issuance of building peanits. 3. The applicant will continue the existing fence to the tree line, in order to screen the new parking from the residential property to the east. 4. A revised landscape plan to further screen headlights from adjacent residential will be submitted for review and approval by City staff. Following �;unstruction of the fence, staff will meet with the applicant to review additional landscaping options. 5. A Variance is approved for a 15 -foot setback from the east lot line, based on the following findings: A. The hardship is created by the existing site conditions and the fact that this parking lot expansion was previously approved with a 15 -foot setback as part of the original Site Plan ("proof -of -parking ). B. The 15 -foot setback is a continuation the existing pairing lot and the request is unique to this site. C. The purpose of the Variance is not based exclusively on the desire to increase the value of the property. D. The hardship is created by the changes in the Zoning Ordinanx. This parking lot expansion, with a 15 -foot side yard setback, was approved as "proof -of -parking" Ping" in the original 1982 Site Plan. E. Granting the Variance will not be detrimental to the public welfare or injurious to other land in the neighborhood. The proposed changes to the puking lot will actually improve the appearance of the parking lot. F. The Variance for a 15 -foot side yard setback will not substantially increase traffic congestion or endanger the public safety. G. This request is the minimum action required to eliminate the hardship in that it is consistent with the previous plans for anticipated future parking needs on the site. • Resolution 97-423 Page 3 6. Prior to issuance of building permits, the developer must obtain permits from Bassett CrecL 7. Standard Conditions: A. Submission of the required Financial Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. B. Any subseiuent phases or expansions are subject to required reviews and approvals per Ordinance provisions. C. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes. and fire lame signage. D. The permit is subject to all qq, icable code% regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on July 16,1997.
