CITY OF PLYMOUTH
RESOLUTION NO. 97 - 414
AUTHORIZING THE VACATION OF A PORTION OF
18" AVENUE STREET RIGHT-OF-WAY
WEST MEDICINE LAKE PARK RECONSTRITCTION
CITY PROJECT NO. 3030
WHEREAS, a petition was received to vacate IP Avenue Right -of -Way ; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed
to be vacated; and
WHEREAS, a public hearing with respect to said vacation was schedulep toe July 9, 1997 in accordance
with Minnesota Statutes 412.851 and the city Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of July 9, 1997; and
WHEREAS, all property owners adjacent to ►he proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on July 9, 1997 to inform any and all interested
parties relevant to the vacation of a portion of I8+ Avenue Street Right -of -Way; and
WHEREAS, it was determined by the City Council that said right of way is not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following portion of le Avenue Street Right -of -Way be
vacated:
The southerly one-half of 10 Avenue (platted as Brook Avenue) lying northerly of, and
Ascent to, the north line of Lot 23, Block 1, ELMHURST GATEWAY 2"D ADDITION
lying easterly of the northerly extension of the wrist line of said Lot 23, Block 1 and
lying westerly of the following described line: Commencing at a point on the south line
of said Lot 23 distant 4 feet westerly of the most southeasterly comer thereof; thence
northwesterly to a point of intersection with the north line of said Lot 23 distant 30 feet
westerly of the most northeasterly comer thereu.^ said point being the actual point of
beginning; thence continuing northwesterly along the prolongation of the last described
line to its point of intersection with the centerline of said 18* Avenue and them
terminating. The City of Plymouth retains an easement for utility purposes over, across,
and through the northerly 10 feet of the vacated 10 Avenue.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
• owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or themunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
