RESOLUTION 97.403
APPROVAL OF LOT DIVISION FOR EMI, MC. TO CREATE TWO LOTS FROM
LOT 4, BLOCK I. CARLSON COMPANIES 2'm ADDITION (97050)
WHEREAS, an application has been filed by the Shaffer Family Limited Partnership
which requests approval of a Lot Division to create two parcels of land from Lot 4, Block
1, Carlson Companies V Addition, as legally described on Attachment One, attached
hez-eto and hereby made a part hereof, and
WHEREAS, the proposed lot arrangement for the Lot Division would revise the lot, as
legally described on Attachment Two, attached hereto and hereby made a part hereof, and
WHEREAS, the City Council has fully considered the request for the Lot Division.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request of the Shaffer Family Limited Partnership for a Lot Division for Lot 4, Block 1,
Carlson. Companies a Addition, located at 13300 - & Avenue North, subject to the
following conditions:
1. No access will be allowed off Xenium Lane North. Access to Parcel A shall be
limited to 10" Avenue North.
2. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm water drainage
facility.
3. Any subsequent phases or expansions are subject to required reviews and approvals
per Ordinance provisions.
4. The permit is subject tv all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
5. Park dedication fees shall be cosh fees in lieu of land dedication in accordance with
the dedication policy in effect at the time of building permit issuance.
6. No building permits shall be issued until the Lot Division is filed and recorded with
Hennepin County.
7. Submittal of required utility and drainage easements as approved by the City
Engineer prior to filing the Lot Division.

8. One incidental wetland basin has been identified on site. A Certificate of Exemption
is required prior to any grading in this area.
9. The Developer shall hold the City and its officers, employees, and agents harmless
fiomr claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer shall indemnify the
City and its offices, employees, and agents for all costs, damages or acpenses which
the City may pay or incur in consequence of such claims, including attorneys' fees.
