RESOLUTION 97-395
APPROVING SITE PLAN AND CONDITIONAL USE PERMIT FOR
BEAUTIFUL SAVIOR LUTHERAN CHURCH FOR PROPERTY LOCATED AT
THE NORTHEAST CORNER OF I494 AND SCHMIDT LAKE ROAD (97961)
WHEREAS, Beautiii l Savior Lutheran Church has requested a Site Plan and Conditional
Use Permit for a church on property legally described as follnv s:
That part of Outlot A, The Meadows of Bass Lake, accorft to the plat thereof of record
in Hennepin County, Minnesota, which lies westerly of Northwest Boulevard; the
westerly line of said Northwest Boulevard being described in Document No. 5934877 as
follows:
Beginning at the southwest corner of said Outlot A; thence North 0 degrees 42 micutes
15 seconds West, assumed bearing along the west line of said Outlot A a distance of
578.67 feet; thence ►►ortheasterly 243.17 feet along a non-tangential curve concave to the
east having a radius of 789.30 feet and a central angle of 17 degrees 39 minutes 06
seconds, the chord of said curve bears north 28 degrees 21 minutes 14 seconds East;
then: Notch 37 degrees 10 minutes 47 seconds East, tangent to said curve 259.20 feet;
thence northeasterly 148.21 feet along a tangential curve concave to the northwest having
a radius of 689.30 feet and a central angle of 12 degrees 19 minutes 11 seconds to the
north gine of said Outlot A and there terminating;

on each side of the center line of the Minneapolis, St. Paul and Sault St. Marie Railroad

WHEREAS, the Planning Commission has reviewed said request at a duly called Pubfiu
Hearing and recommends app►oval;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should ,nd hereby does approve the
request of Beautifal Savior Lutheran Church for a Site Plan u►d Conditional Use Permit
for a church located at the northeast corner of 1-494 and ScImidt Lake Road, subject to
the following conditions:

1. The Site Plan and Conditional Us- Permit allow construction of a church
approximately 32,000 square feet in sine in accordance with the plans received by the
City on May 169 1997, except as amended by this resolution.
2. The Conditional Use Permit shall be recorded on both tax parcels (PID 010.118-22-
13.0002 and 10.1 lb -22-14-0029), that the separate tax parcels will be considered a
single use, and that they may not be conveyed independently.
3. Prior to filing the Conditional Use Permit, the applicant shall provide certification to
the City that there are no delinquent property taxes, special assessments, interest, or
City utility fees dues upon the parcels.
4. Any rignage shall be in compliance with the Ordinance.
S. Wetland buffer monuments shall be placed in accordance with Zoning Ordinance
Section 21670.07.
6. Prior to issuance of a grading permit, the applicant must submit and obtain City
Council approval of a Wetland Mitigation Plan.
7. Trash enclosure must meet 15 -foot wetland buffer setback.
8. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor elevations
for new structures on sites adjacent to, or containing any open storm water
d.-ainage facility.
C. Prior to issuance of building permits, the required Financial Guarantee and Site
Performance Agreement for completion of site improvements within twelve
rr. inths of the date of this Resolution must be submitted.
D. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance pr %visions.
E. Prior to issuance of building permits, plans shall be in compliance with the
Ordinance regarding the location of fire hydrants, fire lanes, and fire lane
signage.
F. An 8112 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the
release or reduction of any site improvement bonds per City Policy.

O. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
H. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started construction of the project, a unless
the landowner or applicant has received prior approval from the City to extend
the expiration date for up to one additional year. as regulated under Section
21045.09 of the Zoning Ordinance.
