RESOLUTION 97-391
AMENDING RESOLUTION 96.560 AND DEVELOPMENT CONTRACT %023 FOR
"THE COURTS AT NANTERRE", REVISING THE ALLOWABLE CONSTRUCTION
MATERIALS FOR THE PRIVATE DRIVES TO INCLUDE DECORATIVE
TEXTURED ASPHALT (96023-F)
WHEREAS, the City Council approved Resolution 96-560 and the corresponding
Development Contract (96023) for Plymouth Oaks on October 16,1996; and
WHEREAS, Condition No. 4 of Resolution 96-560 and Item No. 14.16 of the
Development Contract stated as follows: "The private driveways shall be concrete and
no wider than 18 feet"; and
WHEREAS, the developer has requested that decorative textured asphalt be included as
an allowable construction material for the private drives; and
WHEREAS, decorative textured asphalt would differentiate the private drives from the
public streets, and would provide desirable maintenance characteristics.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does amend the
resolution and development contract for "The Courts at Nanterre" by revising Condition
No. 4 of Resolution 96-560 and revising Item No. 14.16 of the Development Contract, as
follows:

4. The private driveways shall be concrete and/or decorative textured asphalt no
wider than 18 feet. If the private driveways am constructed of decorative
textured asphalt and the Homeowners Association is unable to marntain the
color, texture and appearance of the driveways, the driveways snail be
reconstructed with concrete. The Homeowners Association covenants and
documents shall contain a provision specifically stating that the homeowners
are required to do the necessary maintenance, repair and replacement of the
private driveways.

14.16. The private driveways shall be concrete and/or decorative textured asphalt no
wider than 18 feet. If the private driveways are constructed of decorative
textured asphalt and the Homeowners Association is unable to maintain the

color, texture and appearance of the driveways, the driveways shall be
reconstructed with concrete. The Homeowners Associution covenants and
ducumew shall contain a provision specifically stating that the homeowners
are require' to do the necessary maintenance, repair and replacement of the
private driveways.
