RESOLUTION 97-387
LOT DMSION/CONSOLIDATION FOR PROPERTIES AT 5950 COUNTY ROAD
101 AND 6000 COUNTY ROAD 101 (97076)
WHEREAS, an application has been filed by the Maslon Edelman Borman and Brand on
behalf of D. Bradley and Terri Olah and Alicia Whitehill for a Lot
Division/Consolidation to swap land for two properties located at 5950 County Road 101
and 6000 County Road 101, as legally described on Attachment One, attached hereto and
hereby made a part hereof; and
WHEREAS, the proposed lot arrangement for the Lot Division would revise the lot, as
legally described on Attachment Two, attached hereto and hereby made a part hereof; and
WHEREAS, the City Council has fully considered the request for the Lot Division.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request of Maslon Edelman Borman and Brand for a Lot Division/Consolidation for
properties located at 5950 County Road 101 and 6000 County Road 101, subject to the
following conditions:
1. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new structures on sites adjacent to, or containing any open storm water di. •inage
facility.
2. Any subsequent phases or ekpansions are subject to required reviews and approvals
per Ordinance provisions.
3. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
4. No building permits shall be issued until the Lot Division is filed and recorded with
Hennepin County.
5. The Developer shall hold the City and its officers, employees, and agents harmless
flrom claims made by itself and third parties for damages sustained or costs incurred
resulting from plat approval and development. The Developer sluill indemnity, the
City and its officers, employees, and agents for all costs, damages or expenses which
the City may pay or incur in consequence of such claims, including attorneys' fees.
