MORTENSON COMPANY FOR WAYZATA HIGH SCHOOL AND ELM CREEK pLAYFIELDS LOCATED AT 4955 PEONY LANE NORTH (97049). WHEREAS, M. A. Mortenson Company has requested approval cf a Variance to exceed the 32 -square foot maximum sign area in order to build a 63 -square foot monument sign for Wayzata High School and Elm Creek Play6elds at 4955 Pe+my Lane North, and; WHEREAS, the subject property is legally described as: Parcel 1: The Southwest Quarter of the Northeast Quarter of Section 7, Township I18, Range 22, Hennepin County, Minnesota, according to the Government Survey thereof. Pareel 2: All of the Northwest Quarter of the Northeast Quarter of Sectio- 7, Township 118, Range 22, except the North 980.00 feet thereof, acc')riling to the Oovemment Survey thereof, Hennepin County Minnesota. Pared 3: The East'la of the East'A of the Northwest'/., in Section 7, Township 118 North, Range 22 West of the r Principal Meridian according to the Government Survey thereof, Hennepin County, Minnesota. Parcel 4: Thre West'/a of the Easy, of the Northwest 1/4 of Section 7, Township 1 I8, Range 225 according to the Government Survey thereof, Hennepin County, Minnesota. Parcel S: That part of the East '/a of the East 'h of the Southwest y. of Section 7, Township 118 North, Range 22 West of the 5'1 principal meridian, according to the Govemma-It Survey thereof, which lies north of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to an easement for road purposes ar.4 for ingress and egress over the North 80 feet of above land. Said easement is for the benefit of and appurtenant to, the East 1/4 of the Northwest '/• of said Section, and is to connect with an easement for the same purposes over the North 50 feet of the West 'A of the Southeast Y, ft Res. 97-386 Page 2 of said Section, as shown in Deed Doc. Township 118, Range 22, according to the Government Survey thereof, which lies North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Parcel 7: The East Va of the West 'A of the Southeast Quarter of Section 7, 'township 118 North, Range 22 West of the Sth Principal Meridian, which lies North of the northerly right of way line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad Company. Subject to the rights of the public in Peony lane over the Easterly 33 feet of Parcel 7. WHEREAS, the Planning Commission has reviewed said request at a duly called Public meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE t;ITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by M. A. Mortenson Company for a Variance from the maximum sign area for Wayzata High School and Elm Creek Playfields, based on the finding that the Variance Standards have been met, subject to the following findings and conditions: 1. This Variance allows construction of a 63 square foot monument sign for Wayzata High School where 32 square feet is the maximum sign area, in accordance with the application received by the City on April 24,1997, and updated May 12,1997. 2. A particular hardship has been demonstrated due to the fact that the high school and the playfields are part of an integrated project located on two lots that share a common entrance. The City Council previously determined that the integrated nature of the project did not require the City -owned lot to front on a public street. 3. The Variance is requested In order to allow two integrated uses to share one larger sign and is not appucable to other properties. 4. The Variance request is not based exclusively upon a desire to increase the value of the property. 11 Res. 97-386 Page 3 1. The hardship is baxd upon the integrated nature of this project which is allows the fanctional arrangement of uses, rather than a strict separation. 2. Granting the Variance will not be detrimental to the public welfare or injurious to other land in the neighborhood. 3. Construction of the proposed sign will not interfere with traffic visibility or impede safety by obstructing vision of pedestrians or motor vehicle operators. 4. The 63 square foot sign is requested in place of two 32 square foot signs --one for Wayzata High School and one for Elm Creek Playfields. S.
