HomeMy WebLinkAboutCity Council Resolution 1997-383• CITY OF PLYMOUTH RESOLUTION 97- 383 APPROVING AMENDMENT TO THE DEVELOPMENT CONTRACT FOR DEERWOOD TRAILS (88016) TO ALLOW LOT 12 TO HAVE ACCESS FROM 4r AVENUE NORTH FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF EVERGREEN LANE N. AND 49m AVENUE NORTH WIMREAS, Nagell Construction, the applicant, and Edward Johnston, the property owner, have requested an amendment to the Development Contract for Deerwood Trails for property legally described as follows: Lot 12. Block 2, Deerwood Trails NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OP -THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Nagell Consuuction for an amendment to the Deerwood Trails Development Contract to allow Lot 12 to have access from 48° Avenue North, subject to the following conditions: 1. Fences and accessory structures shall be prohibited between the building line and Evergreen Lane N. 2. The applicant shall plant at least two trees in the front yard setback of Evergreen Lane N. The trees shall be a minimum of 2.5 inches in diameter as measured from six inches above the ground, if deciduous; or a minimum of six feet in height if coniferous. The trees shall be planted prior to issuance of a Certificate of Occupancy. 3. The applicant shall submit a proposed grading plan for review by the City Engineer prior to issuance of a building permit to ensure appropriate drainage is being maintained.
