CITY OF PLYMOUTH
RESOLUTION NO, 97 - 379
AUTHORIZING THE VACATION OF PART OF A
DRAINAGE EASEMENT FOR PONDING PURPOSES
AND PART OF A DRAINAGE AND UTHM EASEMENT
LOT 379 BLOCK 29 BASS L.UM TERRACE SECOND ADDITION
WHEREAS, a petition was received to vacate part of a drainage and utility easement and part
of a drainage easement for ponding purposes in Lot 37, Block 2, Bass Labe Terrace Second
Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for June 18, 1997 in
accordance with Minnesota Statutes 412.851 and the City Charter Scction 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior
to the meeting of June 18, 1997; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on June 189 1997 to inform any and all
interested patties relevant to the vacation of all drainage easements for ponding in Lot 37,
Block 1, Bass Lake Terrace Second Addition; and
WHEREAS, it was determined by the City Council that said easements were not heeded for
public purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the following drainage easement for ponding
purposes be vacated:
That part of Lot 37, Block 2, Bass Lake Terrace Serond Addition, Hennepin
County, Minnesota, described as follows: Commencing at the most southerly
corner of said Lot 37; thence northwesterly along the southwesterly 1[ne of said
Lot 37 a distance of 15.00 feet to the point of beginning of the parcel to be
described; thence continuing along said southwesterly 'inn, a distance of 33.54
feet to the northwesterly line of the drainage and utility easement created over
said Lot 37 by the plat of said Bass Lake Terrace Second Addition; thence
northeasterly along said northwesterly line to a point on the northeasterly line of
said Lot 37 which lies 50.15 feet northwesterly from the most easterly corner of
said Lot 37; thence southwesterly to the point of beginning; except that portion
of said parcel which lies within the southwesterly and northeasterly 6 feet of
said Lot 37.
