HomeMy WebLinkAboutCity Council Resolution 1997-376• CITY OF PLYMOUTH RESOLUTION NO. 97 - 376 AUTHORIZING THE VACATION OF INTERSTATE HIGHWAY NO. 494 RIGHT-OF-WAY WEST SUBURBAN HEALTH CAMPUS WHEREAS, a petition was received to vacate part of Interstate Highway No. 494 right-of-way; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for June 18, 1997 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a nonce of publication of said hearing was published and posted two weeks prior to the mating of June 18, 1997; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on June 18, 1997 to inform ani and all interested parties relevant to the vacation of a part of interstate Highway 494 right-of-way; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following part of Interstate Highway No. 494 right- of-way be vacated: That part of Interstate Highway No. 494 right-of-way, as dedicated in the plat of WEST SUBURBAN HEALTH CAMPUS ADDITION according to the recorded plat thereof, lying southwesterly of Lot 1, Block I, in said plat, and southerly of the following described line: Commencing at the most southerly corner of said Lot 1; thence northwesterly along the southwesterly line of said Lot 1, a distance of 719.97 feet to the point of beginning of the line to be described; thence southwesterly along the south line of said Lot 1, a distance of 4.41 feet to %%vsterly line of said plat. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thea eof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
