HomeMy WebLinkAboutCity Council Resolution 1997-353• CITY OF PLYMOUTH RESOLUTION 97-353 APPROVING VARIANCE REQUEST FOR RUSSEL AND LYNETTE DRAKE FOR PROPERTY LOCATED AT 12810 - 37TH AVENUE NORTH (97044). WHEREAS. Russel and Lynette Drake have requested approval of a Variance to allow a 9 -foot front yard setback where 25 feet is required, in order to construct an attached garage with a second floor family room on their property at 12810 - 37th Avenue North, and; WHEREAS. the subject property is legally described as: That part of the South 'A of the Southeast % of the Southeast % of Section 15. Township 118, Range 22, described as follows: Beginning at a point on the North line of said South % of the Southeast u of the Southeast W distant 669.7 feet East from the Northwest corner thereof; thence South at right angles to said North line a distance of 100 fat to true beginning; thence South on the extension of the last described course distance of 100 fat; thence East at right angles and parallel with the North line of said South 'h of the Southeast % of the Southeast W to the center line of Medicine Lake Road, so called; thence Northwesterly along said center line to the intersection of a line drawn from true beginning and parallel with the North line of said South 1/2 of the Southeast % of the Southeast %; thence West along said parallel line, so drawn to true beginning, according to the United States Government Survey thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Russel and Lynette Drake for a Variance based on the finding that the Variance Standards have been met, subject to the following findings and conditions: • 0 1. This Variance allows construction of an attached garage with a second floor family room with a Moot front yard setback where 25 feet is required, in accordance with the application received by the City on April 28, 1997. 2. The existing driveway shall be removed when the new driveway is completed. 3. A particular hardship to the owner has been demonstrated due to the location of the existing home and the three street fronts on this lot. 4. The Variance is required due to the location of the existing home and is unique to this property. 5. The Variance request is not based exclusively upon a desire to increase the value of the property. 6. The hardship is based upon the location of the existing home and is not a self- created hardship. 7. Granting the Variance will not be detrimental to the public welfare or injurious to other land in the neighborhood. 8. Construction of the proposed garage will not interfere with traffic visibility or impedle safety by obstructing vision of pedestrians or motor vehicle operators. 9. The existing garage is only six -feet from the front lot line, and granting this variance will actually result in an increased setback. Adopted by City Council on June 18, 1997.
