HomeMy WebLinkAboutCity Council Resolution 1997-352• CITY OF PLYMOUTH RESOLUTION 97-52 APPROVING TWO VARIANCE REQUESTS FOR DANIEL AND KATHERINE ERICKSON FOR PROPERTY LOCATED AT 14655 - 13TH AVENUE NORTH (97043). WHEREAS, Daniel and Katherine Erickson have requested approval of a Variance to allow a 5.67 -foot side yard setback where 15 feet is required, and a Variance to allow a 14 -foot rear yard setback where 25 feet is required, in order to construct a garage on their property at 14655 - 13th Avenue North, and: WHEREAS, the subject property is legally described as: Lots 15 and 16, Block 5. Suburbandale on Parker's Lake WHEREAS, the Planning Commission has reviewed said request at a duly called Public meeting and recommends approval; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Daniel and Katherine Erickson for a Variance based on the finding that the Variance Standards have been met, subject to the following findings and conditions: 1. This Variance allows construction of a 624 square foot attached garage with a 5.67 - foot side yard setback where 15 feet is required and a 14 -foot rear yard setback where 25 feet is required, in accordance with the application received by the City on April 15, 1997. 2. The existing shed will be removed when the new garage is completed. • 11 3. A particular hardship to the owner has been demonstrated due to the location of the existing home and the topography of the lot—specifically the steep grade in the front yard. 4. The Variance is required due to the location of the existing home and is unique to this property. 5. Tae Va&= request is not based exclusively upon a desire to increase the value of the property. 6. The Hardship is based upon the topography of the land and is not a self-created hardship. 7. Granting the Varisme will not be detrimental to the public welfare or igjurious to other land in the neighborhood. 8. Construction of the proposed garage will not interfere with traffic visibility or impede safety by obstructing vision of pedestrians or motor vehicle operators. 9. This request is the minimum action required to eliminate the hardship to allow construction of a garage. Adopted by City Council on June 18, 1997. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
