RESOLUTION 97 - 351
APPROVING SITE PLAN AMENDMENT AND TWO VARIANCES FOR KRAUS-
ANDERSON CONSTRUCTION COMPANY FOR ERICKSON'S NEW MARKET
ON PROPERTY LOCATED NORTH OF COUNTY ROAD 6 AND WEST OF
HIGHWAY 101 (97041)
WHEREAS, Kraus -Anderson Construction Company has requested approval of a Site
Plan and two Variances for Erickson's New Market to allow construction of a 7,860
square foot building addition on the property legally described as follows:
Tract C. Registered LAW Survey No. 1301. Files of the Registrar of Titles.
County of Hennepin.
WHEREAS, the Planning Commission has reviewed said request at a duly called
Public Hearing and ra.ommetds approval of the Site Plan and the two requested
Variances;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve
the request by Kraus -Anderson Construction Company for Erickson's New Market for
a Site Plan and two Variances. subject to the following conditions:
1. The Site Plan and Variances for building and drive aisles setback allow the
construction of a 7,850 square foot building addition, according to the plans
received by the City on April 11, 1997 and revised on May 12, 1997, except as
amended by this resolution.
2. This resolution approves a Variance to allow the building to be set back 27 feet
from the west lot line where the Ordinance specifies a minimum setback of 75 feet,
and to allow the drive aisles to be set back 7 feet from the west lot line where the
Ordinance specifies a minimum setback of 10 feet with the funding that the request
meets all the applicable Variance standards, as follows:
a. The applicant has demonstrated a hardship in the location of the existing
building on the parcel. Any reasonable addition to the building would require
a variance or significant interior and exterior renovations to the building and
parking area. In addition, the proposed site plan and variances would allow
the applicant to relocate truck traffic to the opposite side of the building and
away from the residential homes.

b. The purpose of the variation does not appear to be based exclusively upon a
desire to increase the income potential of the property; but rather, to improve
the function of the building and site to provide typical grocery store services.
c. The existing building was not designed to provide the types of services and
products offered m newer super markets. If a neighborhood grocery market ns
to survive at this location, certain improvements sum necessary for it to
compete with other sores. This building would be difficult to renovate and
use for other uses allowed in the C-2 zoning district. For these reasons, the
hardships are not self-created.
d. The granting of the variance should not be detrimental to the pubL: welfare or
injurious to other land or improvements because the building addition would
be located over 150 feet from the nearest home. Further, the building
addition would only encroach 38 feet closer to the homes on the opposite of
Merrimac Lane. Additional landscaping would be provided to maintain and
enhance the existing buffer.

3. Trash and recycling storage containers shall be screened.
4. This resolution approves a Variance to the Fire Code requirement for a fire lane
within SO feet of all sides of the building, subject to the conditions contained in the
Fire Inspector's Memorandum.
S. Roof -top equipment shall be screened with an enclosure to help reduce noise and
eliminate off-site views. The applicant shall submit plans for the rooftop equipment
screening for staff review.
6. A revised grading plan shall be submitted for staff review prior to issuance of
building permits.
7. At least one landscape island shall be placed in each row of parking near the dont

S. The applicdnt shall submit additional financial guatantees to cover the cost of
replacing any trees lost or severely damaged during construction. Any replacement
trees shall be a minimum of ten (10) feet in height.

9. Sign permits are required prior to erecting any signs on the property.
10. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites adjacent to, or containing any open
storm water drainage facility.
C. Submission of required Financial Guarantee and Site Performance
Agreement for completion of site improvements within twelve months of
the date of this resolution.
D. Any subsequent phases or expansions are subject to requited reviews and
approvals per Ordinance provisions.
E. Compliance with all Fire Codes and policies, including those regarding
the location of fire hydrants, fire lanes, and fire lane signage.
F. An 8 1/2 x 11 inch 'As Built" Fire Protection Plan shall be submitted
prior to the release or reduction of any site improvement bonds per City
Policy.
G. Prior to issuance of building permits, submission and approval of fire
flow calculations.
H. This approval shall expire one year after the date of approval, unless the
property owner or applicant has substantially started construction of the
project, or unless the landowner or applicant has received prior approval
from the City to extend the expiration date for up to one additional year,
as regulated under Section 21045.09 of the Zoning Ordinance.
