HomeMy WebLinkAboutCity Council Resolution 1997-34311 CITY OF PLYMOUTH RESOLUTION 97 343 APPROVING PRELIMINARY PLAT AND SITE PLAN FOR MOEN LEUER CONSTRUCTION FOR PROPERTY LOCATED NORTH OF HIGHWAY 55, SOUTH OF 36M AVENUE AND EAST OF ROCKFORD ROAD (97012) WHEREAS, Moen Leuer Construction has requested approval of a Prelfarmi ry Plat and Site Plan to create two lots for construction of two office buildings on property legally described as: That part of the west half of the northeast quarter of Section 20, Township 118, Range 22, which ties north of the northeasterly right of way line of State Highway Number 55, except road. WHEREAS, the Planning Commission has re+iewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Moen Leuer Construction for a Preliminary Plat and Site Plan, subject to the following conditions: 1. Approval of the Preliminary Plat and Site Plan are subject to the approval of the Rezoning application. 2. A Preliminary Plat is approved for the creation of two lots. 3. A Site Plan is approved for one 82,749 squaw -foot building on Lot 1 and one 55,922 square - foot building on Lot 2, according to the plans received by the City on March 20, 1997, except as amended by this resolution. 4. Allowable building area calculations (the allowable size of the building with respect to the proposed building material type and interior use of the building) will be finalized with the Building Department prior to issuance of building permits. 5. Required deciduous trees will have a minimum diameter of 2.5 -inches, as outlined in Section 21130.03 of the Zoning Ordinance. 6. Signage for this site shall be in compliance with the Sign Ordinance in effect at the time of sign permit application. The current Sign Ordinance allows only one monument sign per lot, not the three monument signs proposed for this development. 7. Trash enclosures will be provided inside each building. 8. No outdoor storage will be showed on site. • • 97012pp, Page 2 9. Prior to approval of the Final Plat, the owner must submit executed documents in recordable form for required drainage and utility easements. The City will require ten foot wide drainage and utility easements adjoining all streets and six feet wide adjoining side and rear lot lines. 10. A drainage easement for ponding will be required for property lying below the 100 year high water elevation will be required prior to approval of Final Plat. 11. Cross -easements between the two new lots for sanitary sewer, watermain, storm sewer, ponds, drives and parking must be filed with Hennepin County prior to approval of the Final Plat. 12. Wetland buffer monuments shall be placed in accordance with Zoning Ordinance Section 21670.07. 13. Spring follow-up of wetland delineation will be required prior to any activity impacting the wetlands. Approval of the Site Plan is contingent upon the results of the spring follow-up and City Council approval of the Wetland Mitigation Plan. 14. Fountains will not be allowed in the NURP ponds. 15. Provide a 10:1 bench for all ponds on site. 16. Show the two culvert crossings under Highway 55, including invert elevations. 17. Prior to issuance of building permits, the developer must obtain permits from the MN Department of Natural Resources, MN Department of Transportation, Minnehaha Creek, Army Corps of Engineers, NPDES, and the City for the Wetland Conservation Act. 18. Relocate the driveway to within Outlot 3. The existing curb cut shall be used for the entrance. 19. Access to the site will be provided over Outlot B, Sugar Hills ) d Addition. Easements must be filed with Hennepin County prior to approval of the Final Plat. 20. An all -way stop will be installed at 36' Avenue and Zanzibar Lane. The developer will be responsible for the installation of a stop sign on the private drive at access 36'" Avenue. 21. When the vacant property located to the east of this site is developed, the City will examine Wditional access options for the West Olen Corporate Center. If traffic conditions allow, and there is an opportunity to extend a new public street through that parcel to West Glen or to provide private access easements, the Developer will cooperate with and comply with any access changes requested by the City in order to provide a second access to the site. • 0 97012pp, Page 3 22. The site plan is approved without the proposed berm on Oudot C, Sugar Hills 31 Addition. if the developer and the HOA can agree to build the berm, the berm and plantings may be administratively approved if the berning is in substantial conformance with plans received by the City on March 20.1997. 23. Standard Conditions. A. Compliance with Policy Resolution 7940 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. B. Submission of the required Financia[ Guarantee and Site Performance Agreement for completion of site improvements within twelve months of the date of this Resolution. C. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. D. Compliance with the Ordinance regarding the location of fire hydrants, fire lanes, and fire lane signage. E. An 81R x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. F. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. G. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. H. The Developer shall hold the City and its officers, employees, and agents harmless from claims made by itself and third parties for damages sustained or costs incurred resulting fioom plat approval and development. The Developer shall indemnify the City and its officers, employees, and agents for all costs, damages or expenses which the City may pay or incur in consequence of such claims, including attorneys' fees. 1. No building permits shall be issued until the Final Plat is Fled and recorded with Hennepin County. J. No building permits shall be issued until a contract has been awarded for construction of municipal sewer and water. K. Compliance with regulations regarding handicapped parking spaces and access.
