HomeMy WebLinkAboutCity Council Resolution 1997-3390 CITY OF PLYMOUTH RESOLUTION NO. 97 - 339 AUTHORIZING THE VACATION OF DRAINAGE AND IrMIiTY EASEMENTS, LOT 29 BLOCK Is PLYMOUTH HILLS 6TH ADDITION WHEREAS, a petition was received to vacate part of the drainage and utility easements, in Lot 2, Block I. Plymouth Hills 66 Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for June 4. 1997 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of June 4,1997; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on June 4, 1997 to inform any and all interested parties relevant to the vacation of part of the drainage and utility easements, in Lot 2, Block I. Plymouth Hills a Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage and utility easements, be vacated: That part of the drainage and utility easement ares, 20.00 feet wide, over, under and across the south 20.00 feet of Lot 2, Block 1, Plymouth Hills & Addition, as said easement is delineated on said plat, lying east of the west 10.00 feet of said Lot 2 and lying west of the right of way the cul-de-sac of 35" Avenue North. Together with the drainage and utility easement area, 10.00 feet wide, over, under and across the south 10.00 feet of said Lot 2 lying easterly of the above described 20.00 foot wide easement area, FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
