RESOLUTION NO. 97 - 338
AUTHORIZING THE VACATION OF PART
OF 3Su AVENUE NORTH STREET RIGHT-OF-WAY
LOT 19 BLOCK 59 PLYMOUTH HILLS
LAT 29 BLOCK 11, PLYMOUTH HILLS 6M ADDITION
W14ERE&S, a petition was received to vacate part of 356 Avenue North street right-0f-wAy. Lot
1, Block 5, Plymouth Hills and Lot 2. Block I, Plymouth Hills 66 Addition; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for June 4. 1997 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of June 4.1997; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail;
and
WHEREAS, the Council did hold a public hearing on June 4, 1997 to inform any and all
interested parties relevant to the vacation of part of 356 Avenue North sheet right-of-way, Lot 1,
Block 5, Plymouth Hills and Lot 2. Block 1, Plymouth Hills 66 Addition; and
WHEREAS, it was determined by the City Council that said right-of-way is not needed for
public purposes;
NOW, THEREFORE. BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the following part of 356 Avenue North street fight -of -
way, Lot 1, Block 5, Plymouth Hills and Lot 2. Block 1, Plymouth Hills a Addition be vacated:
That part of 356 Avenue North as delineated on the plat of Plymouth Hills lying
westerly of a line drawn from the northeast comer of Lot 1, Block 5, Plymouth
1144 to the southeast comet of Lot 2, Block 1, Plymouth Hills 66 Addition.
FURTHER, that said vacation shall not affect the authority of arty person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas and sewer liens,
water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to
enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise
attend thereof.
Adopted by the City Council on June 4. 1997.
