RESOLUTION 97 -321
APPROVING PRELIMINARY PLAT FOR NORTH COUNTRY PROPERTIES FOR
NORTH COUNTRY ESTATES LOCATED SOUTH OF SOUTH SHORE DRIVE.
EAST OF THE CITY OF MEDICINE LAKE, AND WEST OF BASSETT CREEK

WHEREAS, North Country Properties has requested a Preliminary Plat for North
Country Estates. a plat of three single Gmily lots on a 4.7 -acre parcel located south of
South Shore Drive, east of the City of Medicine Lake, and west of Bassett Creek; and
WHEREAS, the subject property is legally described as follows%
Lots 1. 2, 17 and 18. Block 13; Lots 5 and 6, Block 14. except the south 233.00 feet
thereof; all in Med--ine Lake Park First Division, Hennepin County, according to the
recorded plat thereof. Together with that part of vacated Columbia Avenue accruing.
WHEREAS, the Planning Commission has reviewed the Preliminary Plat at a duly called
Public Hearing and recommends approval.
NOW. THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA9 that it should and hereby does approve the
request of North Country Properties for a Preliminary Plat for North Country Estates
located south of South Shore Drive, east of the City of Medicine Lake, and west of
Bassett Creek subject to the following conditions:
1. Preliminary Plat approval is hereby granted for North Country Estates in accordance
with the plans received by the City on Match 7. 1997, except as amended by this
resolution.
2. The developer shall provide the City with a trail easement over the northerly twelve
(12) feet of Lots 1.2. and 3.
3. The minimum front yard setback shall be thirty-five (35) fxt.
4. The applicant shall submit a revised grading plan for staff review prior to City
Council consideration of the Final Plat.
5. Develooment of the subdivision shall comply with the City's Tree Preservation
Ordinance.
6. Buffer monuments shall be placed in accordance with Zoning Ordinance Section
21670.07.

7. The developer must obtain all necessary permits from the DNR and Bassett Crede
Watershed District prior to installation of the water main.
8. The minimum basemecd elevation shall be 892 for all Lass. The applicant shall
VC* at the time of building permit application that the lowat floor elevation is at
least three (3) feet above the high water mark.
9. Soil botinga shall be required prior to building permit issuance.
10. rae developer shall extend municipal water to all lots and to the westerly lot line of
Lot 1.
11. The total impervious indkees on each lot may not exceed twenty-five (25) percent.
12. A fire hydrant shall be installed at the waterly lot line of Lot 1.
13. Standard Conditions;
A. Compliance with the City Engineer's Memorandum.
B. Removal of all hazardous trees from the property at the ownees
expensL
C. No building permits shall be in ud until a contract has been awarded for
the extension of water services.
D. Compliance with Policy Resolution 79-80 regarding minimum floor
elevations for new structures on sites a4iwent to, or containing any open
atorm water drainage facility.
E. No building permits shall be issued until the Final Plat is filed and
recorded with Hennepin County.
F. Submittal of required utility and drainage easement documents as
approved by the City Engineer prior to filing the Final Plat.
O. The Developer shall hold the City and its officers, employees. and agents
harmless from claims made by itself and third parties for donna
sustained or costs incurred resulting f%om plat approval and development.
The Developer shall indemnify the City and its officers, employees, and
agents for all test% damages, or e.cpenses which the City may pay or incur
in consequence of such claims, including attorneys' fees.
H. Payment of park dedication fees -in -lieu of dedication in accordance with
the Dedication Policy in effect at the time of recording the Final Plat.

J. No Zoning Ordinance Variances are granted or implied.
