HomeMy WebLinkAboutCity Council Resolution 1997-318• CITY OF PLYMOUTH RESOLUTION 97 - 318 APPROVING LOT DIVISION AND VARIANCES FOR PAUL HANSEN AND REM" RESUL!S, INC. FOR PROPERTY LOCATED AT 9705 -27TH AVENUE NORTH (96177) WHEREAS, an application has been filed by Paul Hansen and Re/Max Results, Inc. which requests approval of a Lot Division and Variances to divide a parcel of land generally located at 9705-27r Avenue North, legally described on Attachment One, attached hereto and hereby made a part hereof; and WHEREAS, the proposed lot arrangement for which the Lot Division is sought is as legally described on Attachment Two, attached hereto and hereby made a part hereof; and WHEREAS, the Planning Commission has reviewed the request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request of Paul Hansen and Re/Max Results, Inc. for a Lot Division and Variances for property located at 9705-27* Avenue North, subject to the following conditions and findings: 1. The Lot Division request is hereby approved in accordance with the plans received by the City on May 1. 1997, except as amended by this resolution. 2. This resolution approves Variances to allow two lots to be created with a lot width of less than 110 feet, with the finding that the applicable Variance standards are met. Specifically, a) the drainage ditch creates a hardship with respect to accessibility, use and maintenance of the western portion of the lot, b) the Variances would allow reasonable use of this l 15 -acre site, c) unusual conditions relate to the site because it more than enough land area for two lots, yet is slightly under the width required to create two lots without the Variances d) the Variances would not have adverse impacts on surrounding properties, e) the lots resulting from this in -fill development project would be generally consistent with the established development pattern of the surrounding neighborhood, if the existing stwface drainage ditch is routed into a storm sewer pipe to allow for a suitable building pad on the new lot; and f) the Variances N ould not impair an adequate supply of light or air to adjacent properties, nor would they substantially increase the congestion of public streets. • Resolution 97- 318 (96177) Page 2 3. The Lot Division shall not be recorded with Hennepin County until the Park Dedication Fee for one residential lot is submitted to the City. 4. No building permits shall be issued until the Lot Division is recorded with Hennepin County. 5. Prior to recording the Lot Division. revised plans shall be submitted indicating the required 15 -foot wide (average) wetland buffer strip on all sides of the wetland, and the 15 -foot structure setback from the buffer edge. 6. Prior to issuance of a building permit, the owner shall coordinate the final design of the drainage with the City Engineer to ansure that the potential for erosion is minimized. 7. Prior to the issuance of building permits, wetland buffer monuments shall be installed in accordance with Section 21670.07 of the Zoning Ordinance. The monument design shall be approved by the Community Development Department. 8. Compliance with the City's Tree Preservation Ordinance. 9. The Water Area Assessment, Watermain Lateral Assessment, and SAC and REC charges shall be paid with the building permit for the proposed home on Parcel A. 10. The minimum basement elevation for the proposed home on Parcel A shall be 914.0. 11. A drainage and utility easement will be required to the top of the bank of the drainage ditch. 12. The developer is responsible for the construction of the necessary sanitary sewer and water services to the new lot, and the cost of repairing 21" Avanue. 13. The project will fill less than 2,000 square feet of wetland, therefore, is exempt from the wetland act. 14. Standard Conditions: A. Compliance with the City Engineer's Memorandum, except for consuuctiun of a storm sewer (items 13B and 13C.) B. Removal of all hazardous trees firm the property at the owner's expense. C. Compliance with Policy Resolu tion 79-80 regarding minimum floor D. elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. E. Submittal of required utility and drainage easement documents, as approved by the City Engineer, prior to filing the Lot Division. Adopted by the City Council on May 28,1997.
