RESOLUTION 97 -312
dBURSING DEVELOPER FOR
G COSTS REQUUM TO CONSTRUCT
SCBM' LAKE ROAD
CITY PROJECT NO. 3016
WHEREAS, the City of Plymouth and Weston Corp. have entered into a development
contract dated December 11, 1995 for the development of Nanterre Subdivision; am
WHEREAS, as part of tlds development, the developer was required to construct Schmidt
Lake Road, according to State Aid Standards, in Nanterre Subdivision from Vicbburg
Lane west to the C.P. Railroad trach; and
WHEREAS, as part of the construction of Schmidt Lake Road, the developer is to be
reimbursed for the engineering costs associated with the design and constnution; and
WHEREAS, the work to date is certified to conform with State Aid standards for street
construction by Weston Corp.'s engineer as detailed in the approved plans and
specifications; and
WHEREAS, to date enghmr ft costs amount to 515039.44; and
NOW, 71][BREFORE, BE IT HEREBY RESOLVED BY IS CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the developer, Weston Corp., is to be
reimbursed in the amount of $154,039.44 for engineering costs relating to the construction
to date of Schmidt Labe Road in accordance with the development contract and City
iolicy.
BE IT FURTHER RESOLVED that the funds be allocated from the City's MSA Fund.
Adopted by the City Council on May 28, 1997.
