CITY OF PLYMOUTH
RESOLUTION NO. 97- 291
RESOLUTION APPROVING AN EASEMENT AGREEMENT BETWEEN THE CITY
OF PLYMOUTH AND DUNKIRK INVESTiAENT COMPANY FOR ACCESS OVER
OUTLOT B, CIC NO. 696, SUGAR HILLS 31D ADDITION
WHEREAS, Outlot B, CIC No. 6%, Sugar Hills 3'a Addition is owned by the City of
Plymouth; and
WHEREAS, Dunkirk In iestment Company is the owner of the property legally described
as follows:
That part of the west half of the northeast gruuter of Section 20, Township 118, Range 22,
which lies north of the northeasterly right of way line of State Highway Number 55,
exceptroad.
WHEREAS, Dunkirk Investment Company has requested access to the above described
property over Outlot B, CIC No. 696, Sugar Hills 3rd Addition; and
NOW, THEREFO.RJ-,, BE IT RESOLVED BY THE CITY COUNCIL CF THE CITY
OF PLYMOUTH, MINNESOTA, that the Mayor and Clerk are hereby authorized to
sign, on behalf of the City of Plymouth, easement agreements that will permit Dunkirk
Invenstment Company, its successors and assigns, to access the above described property
over the City's outlot, subject to the following findings and conditions;
1. Dunkirk Investment Company will clear the lis pendens filed against Outlot B, CIC
No. 696, Sugar Hills 3'd Addition, prior to recording the easement agreements with
Hennepin County.
