RESOLUTION 97 - 290
APPROVING AN INTERIM USE PERMIT FOR MOEN LEUER CONSTRUCTION
FOR DEPOSIT OF FILL AT PROPERTY LOCATEu SOUTH OF 36m AVENUE,
NORTH OF MQHWAY 55, AND EAST OF ROCKFORD ROAD (97039)
WHEREAS, Moen Leuer Construction has requested a Interim Use Permit to allow
deposit of fill on property legally described as follows:
That part of the west half of the northeast quarter of Section 20, Township 118, Range 22,
which lies north of the northeasterly right of way line of State Highway Number 55,
except road.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFOkE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Moen Leuer Construction for an Interim Use Permit, subject to the following
conditions:
1. The Interim Use Permit is to allow deposit of 4,000 cubic yards of fill according to
the plans received by the City on April 10, 1997, except as amended by this
resolution.
2. A grading permit from the building department is required prior to deposit of fill on
this site.
3. Prior to issuance of a grading permit, written right -of -entry must be provided to the
Zoning Administrator to enter the land for the purpose of determining compliance
with all applicab.e conditions imposed on the operation.
4. No fill will be deposited in wetlend areas. Prior to issuance of a grading permit, plans
must be revised to show fill located in an upland area.
5. The developer shall send the stock pile plan to Minnehaha Creek for their review and
approval.
6. A Financial Guarantee is regtdred as part of the building permit application.
7. Silt fence shall be placed 10 feet from the toe of the slope around the entire stock pile
area.

B. At the completion of the landfilling operations the premises shall be graded, leveled,
and seeded or sodded with grass. The developer will be required to level, seed and
mulch the stockpile by September 10,1997.
9. Prior to issuance of a grading permit, the owner must receive an access easement from
the owner of Oudot B, the City of Plymouth.
